ABSTRACT
In concert with the Village's newly adopted Comprehensive Plan the adopted amendments include changes to use and dimensional regulations for both residential and non-residential districts to addresses the changing needs and desires of the Port Chester community.

Text Amendments

Residential Districts

Strategic upzonings in all residential districts through a reduction of potential Floor Area Ratio ("FAR"); A reduction in permitted building height in the RA3 and RA4 Multi-Family Residential Districts; Eliminates regulations for cluster development in the R2F Two-Family Residential District (Section 345-16) and the PTD Planned Tower Development District (Section 345-46).

Nonresidential Districts

Renames and modifies C2 Central Business District to C2 Main Street Business District to include an increase in FAR from 3.2 to 4.0 by bonus and reduction in permitted height from 8 to 5 stories; Renames the C3 Design Office and Commercial District to C3 Office and Commercial District.

Creation of C5 Train Station Mixed Use and C5T Downtown Mixed Use Transitional Districts to provide opportunity for higher density mixed use development in the downtown core. The C5 and C5T Districts have a permitted FAR of 4.0 (bonus to 4.5) and will allow building heights of eight (8) and five (5) stories, respectably, to transition into four-story maximum height in the existing DW Design Waterfront District and newly created DW2 Downtown Design Waterfront District. The DW2 Downtown Design Waterfront District has an FAR of 2.4 (bonus to 2.6), front and side yard setbacks of five feet, 25 foot rear yard setback and required lot area per dwelling unit of 600 square feet to preserve view corridors and vistas to the Byram River waterfront and protect the natural environment.

The site of the former United Hospital has been rezoned to the PMU Planned Mixed Use District to provide opportunities for appropriately scaled and context-sensitive redevelopment through a variety of commercial, office, residential, or community facility uses. With a maximum FAR of .8 (bonus to 1.0) the PMU district apportions permitted FAR by land use to encourage mixed use development in concert with the Village's Comprehensive Plan: Hotel/Conference Center .4, Commercial .2, Residential .2, Age-Restricted/Assisted Living .3, Community Facilities .1. Permitted building heights of 5 Stories for all commercial/residential uses and 8 stories for hotel/conference center with a 2 story building height bonus available.

The PRSP Planned Railroad Station Plaza Development District has been eliminated.

Other Zoning Provisions

Establishes a Building Height and Floor Area Bonus Program (Section 345-16) for the C2 Main Street Business, C5 Train Station Mixed Use, C5T Downtown Mixed Use Transitional, PMU Planned Mixed Use, and DW2 Downtown Design Waterfront District whereby an increase in permitted FAR and/or height can be achieved by paying into a dedicated open space, housing rehabilitation, or downtown parking garage fund as approved by the Village Board of Trustees.

Establishes a fee in lieu of required 50 square feet open space per unit for the C2 Main Street Business, C5 Train Station Mixed Use, C5T Downtown Mixed Use Transitional, DW Design Waterfront, and DW2 Downtown Design Waterfront District. The value shall be based on 50 percent of the assessed value of the land on the site, calculated by utilizing the 50 square feet of land per unit and shall be utilized for the acquisition, preservation of improvement of open space.

Amends the Schedule of Regulations for Residence and Nonresidence Districts
