NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that a public hearing pursuant to Article 18-A of the New York General Municipal Law (the “Act”) will be held by the Village of Port Chester Industrial Development Agency (the “Agency”) on Thursday December 2, 2021 at 6:30 p.m. at the Village of Port Chester Senior Center, 222 Grace Church Street, Port Chester, New York 10573, in connection with the matter described below. 

TARRY LIGHTHOUSE LLC, for itself and/or a related entity or entities to be formed (collectively, the “Company”), has submitted an application to the Agency requesting the Agency’s assistance with a certain project (the “Project”) consisting of: (i) the acquisition by the Agency of a leasehold interest in approximately 1.2 acres of real property comprised of five (5) parcels of land located at 20 Abendroth Avenue, 18 Mill Street, and 179, 175 and 163 North Main Street,  Port Chester, New York (the “Land”, being more particularly described as tax parcel numbers 142.23-2-25, 26, 27, 28 and 29) along with the existing improvements thereon consisting principally of various residential, warehousing and parking space (the “Existing Improvements”); (ii) the demolition, renovation, reconstruction and rehabilitation of the Existing Improvements and the planning, design, construction, operation and leasing by the Company of a six story multi-tenanted, mixed use redevelopment project that will include: (a) approximately 209 residential apartment units, (b) approximately 27,905 square feet of multi-tenanted and mixed use commercial/retail space, (c) structured parking improvements in and around the various structures providing for approximately 271 parking spaces, and (d) other amenities, various subsurface structural improvements, roadway improvements, access and egress improvements, storm water improvements, utility improvements, signage, curbage, sidewalks, and landscaping improvements (collectively, the “Improvements”); (iii) the acquisition of and installation in and around the Existing Improvements and Improvements by the Company of machinery, equipment, fixtures and other items of tangible personal property (the “Equipment” and, collectively with, the Land, the Existing Improvements and the Improvements, the “Facility”); and (iv) entering into a straight lease transaction (within the meaning of subdivision (15) of Section 854 of the Act), pursuant to which the Agency will retain a leasehold interest in the Facility for a period of time and sublease such interest in the Facility back to the Company (the “Straight Lease Transaction”).

The Agency is contemplating providing financial assistance to the Company with respect to the Project (collectively, the “Financial Assistance”) in the form of:  (A) an exemption from all State and local sales and use taxes with respect to qualifying personal property included in or incorporated into the Facility or used in the acquisition, construction or equipping of the Facility; (B) mortgage recording tax exemption(s) relating to financings undertaken by the Company in furtherance of the Project, and (C) a partial real property tax abatement through a payment-in-lieu-of-tax agreement (collectively, the “PILOT Agreement”), pursuant to which the Company would make payments in lieu of real property taxes to each affected tax jurisdiction (the “Affected Tax Jurisdictions”). 

In accordance with Section 859-a of the Act, a representative of the Agency will be at the above-stated time and place to present a copy of the Company’s Project Application (including a cost-benefit analysis), which is also available for viewing on the Agency’s website at: https://www.portchesternyida.org/public-hearing-notices. Interested parties be provided a reasonable opportunity, both orally and in writing, to present their views with respect to the Project.  The Agency will also stream the public hearing via a video link that will also be provided at https://www.portchesterny.gov/pc-tv/pages/live-stream.  Finally, the Agency also encourages all interested parties to submit written comments to the Agency, which will all be included within the public hearing record.  The Agency also welcomes and encourages written comments to be submitted to the Port Chester Industrial Development Agency (PCIDA) at 222 Grace Church Street, Room 202, Port Chester, New York 10573 and/or [email protected] and (914) 758-7399.

No bids will be received or considered after the date/time stated above.

Proposals that do not include an electronic format submission will not be considered.

This work consists of the installation of approximately 440 linear feet of six-foot high White Vinyl PVC fencing and four single-swing gates.

A Pre-Bid conference will not be held. Bidding contractors are strongly encouraged to visit the project site before submitting bids.

Plans, Specifications and Contract Documents may be procured at the Office of the Village Clerk, 222 Grace Church Street, Port Chester, New York beginning on November 22nd, 2021 and available on the Village’s web-page www.portchesterny.com/bids or in-person at the office during regular business hours.

The Board of Trustees of the Village of Port Chester reserves the right to accept or reject any or all bids, waive any informalities at its discretion, and to make such bid award that it deems is in the best interest of the Village of Port Chester even if such award is to other than the lowest bidder.

NOTICE IS HEREBY GIVEN that pursuant to a resolution of the Board of Education of the Blind Brook-Rye Union Free School District, in the County of Westchester, New York, adopted on October 28, 2021, a Special District Meeting of the qualified voters of said School District will be held on

Tuesday, December 21, 2021

from 7:00 o’clock A.M. to 9:00 o’clock P.M. (Prevailing Time) in the Fabrication Lab of the Blind Brook High School on King Street, Rye Brook, New York, for the purpose of voting upon the following Bond Proposition in substantially the following form:

(a) That the Board of Education of the Blind Brook-Rye Union Free School District, in the County of Westchester, New York (the “District”), is hereby authorized to expend the amount of not to exceed $6,000,000 in addition to the amount heretofore approved by the voters on October 17, 2017 for the construction of alterations and improvements to District buildings and sites, such additional amount needed on account of unanticipated increases in the costs thereof; (b) that a tax is hereby voted therefor in the amount of not to exceed $6,000,000 to finance such additional cost, such tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and (c) that the Board of Education may authorize the issuance of an additional not to exceed $6,000,000 serial bonds and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable.

The voting will be conducted by ballot on voting machines or paper ballot as provided in the Education Law and the polls will remain open from 7:00 o’clock A.M. to 9:00 o’clock P.M. (Prevailing Time) and as much longer as may be necessary to enable the voters then present to cast their ballots.

NOTICE IS FURTHER GIVEN, that members of the Board of Registration shall meet on Monday, December 13, 2021, between the hours of 4:00 o’clock P.M. and 8:00 o’clock P.M. (Prevailing Time) in the District Clerk’s office at the Bruno M. Ponterio Ridge Street School, Rye Brook, New York, for the purpose of preparing a register of the qualified voters of the District for said Special District Meeting, at which time any person shall be entitled to have his/her name placed upon such register, provided that at such meeting of the Board of Registration he/she is known or proven to the satisfaction of such Board of Registration to be then or thereafter entitled to vote at said Special District Meeting.

The register of the qualified voters of said District prepared for the Annual District Meeting and Election held on May 18, 2021 shall be used by said Board of Registration as the basis for the preparation of the register for said Special District Meeting to be held on December 21, 2021. Any person whose name appears on such register or who shall have been previously registered for any annual or special District meeting or election and who shall have voted at any annual or special district meeting or election held or conducted at any time since January 1, 2017, will not be required to register personally for this Special District Meeting. In addition, any person otherwise qualified to vote who is registered with the Board of Elections of Westchester County under the provisions of the Election Law shall be entitled to vote at said Special District Meeting without further registration.

Following the meeting of the Board of Registration, such register will be filed in the Office of the District Clerk, where such registers will be open for inspection by any qualified voter of said School District, between the hours of 9:00 o’clock A.M. and 3:00 o’clock P.M. (Prevailing Time), except Sunday and on Saturday, December 18, 2021,  by appointment only.

NOTICE IS FURTHER GIVEN that applications for absentee ballots may be applied for at the office of the District Clerk at the Bruno M. Ponterio Ridge Street School, Rye Brook. An application for an absentee ballot, on a form provided by the District Clerk, shall be made to the District Clerk, at least seven (7) days before the Special District Meeting, if the School District Clerk is to return the absentee ballot to the applicant by mail.  If the applicant is to personally pick up the absentee ballot, the application must be received by the School District Clerk at least one (1) day before the Special District Meeting.

A list of all persons to whom absentee ballots shall have been issued will be available in the office of the District Clerk between the hours of 9:00 o’clock A.M. and 3:00 o’clock P.M. (Prevailing Time) on each of the five (5) days prior to the day of the election, except Saturday and Sunday. In order to be canvassed, an absentee voter’s ballot must be received in the District Clerk’s office by 5:00 o’clock P.M., prevailing time, on the day of the Special District Meeting.

AND FURTHER NOTICE IS HEREBY GIVEN, that Education Law also makes special provisions for absentee voting for “military” voters of the District. Specifically, the law provides a unique procedure for “military ballots” in school district votes. Whereas absentee ballots must be received by the voter by mail, a military voter may elect to receive his/her absentee ballot application and absentee ballot by mail, email or facsimile. If a military voter does not designate a preference, the board of education shall transmit the military ballot application or military ballot by mail. If a military voter designates a preference for facsimile transmission or electronic mail but does not provide the necessary facsimile number or e-mail address, the board of education shall transmit the voter registration application, military ballot application or military ballot by mail and request the omitted information. The military voter must, however, return his/her original military ballot application and military ballot by mail or in person, regardless of how the absentee application or ballot was received. The Clerk of the Board shall transmit the military voter’s military ballot in accord with the military voter’s preferred method of transmission, or if not preference by mail, not later than November 26, 2021. The Clerk of the Board must then receive the military voter’s military ballot by mail not later than 5:00 p.m. on the day of said Special District Meeting.

Only qualified voters who are registered to vote will be permitted to vote.

 La votación se llevará a cabo mediante boleta en máquinas de votación o boleta de papel según lo dispuesto en la Ley de Educación y los centros de votación permanecerán abiertos a partir de las 7:00 A.M hasta las 9:00 P.M. (hora vigente) y más tiempo según sea necesario para permitir que los votantes presentes emitan sus votos.

SE DA AVISO ADEMÁS, que los miembros de la Junta de Registro se reunirán el jueves 9 de diciembre de 2021, entre las 4:00 P.M. y las 8:00 P.M. (hora vigente) en la oficina de la Secretaria de Distrito en la Escuela Bruno M. El registro de los votantes cualificados de dicho Distrito preparado para la Elección y Reunión Anual del Distrito Escolar celebrada el 18 de mayo de 2021, será utilizado por dicha Junta de Registro como base para la preparación del registro para dicha Reunión Especial del Distrito que se realizará el 21 de diciembre de 2021. Cualquier persona cuyo nombre aparezca en dicho registro o que se haya registrado previamente para una reunión o elección anual o especial del Distrito y que haya votado en cualquier reunión o elección anual o especial del Distrito celebrada o realizada en cualquier momento desde el 1 de enero de 2017, no necesita registrarse personalmente para esta reunión especial del distrito. Además, cualquier persona cualificada para votar que esté registrada en la Junta Electoral del Condado de Westchester bajo las disposiciones de la Ley Electoral tendrá derecho a votar en dicha Reunión Especial del Distrito sin más registro.

Se solicitará a la Secretaria de Distrito una boleta de voto en ausencia, en un formulario proporcionado por la Secretaria de Distrito, al menos siete (7) días antes de la Reunión Especial del Distrito, si la Secretaria del Distrito Escolar debe devolver la boleta de voto en ausencia al solicitante por correo. Si el solicitante va a recoger personalmente la boleta de voto en ausencia, la solicitud debe ser recibida por la secretaria del Distrito Escolar al menos un (1) día antes de la Reunión Especial del Distrito.

Una lista de todas las personas a quienes se han emitido las boletas de voto en ausencia estará disponible para inspección pública en la oficina de la Secretaria del Distrito entre las 9:00 AM y las 3:00 PM. (hora vigente) cada uno de los cinco (5) días anteriores a la fecha establecida para la votación, excepto el sábado y domingo. Para ser contada, la boleta de un/a votante ausente debe recibirse en la oficina de la Secretaria del Distrito antes de las 5:00 P.M., hora vigente, el día de la Reunión Especial del Distrito.

Y ADEMÁS SE AVISA, que la Ley de Educación también establece disposiciones especiales para el voto en ausencia para los votantes "militares" del Distrito. Específicamente, la ley proporciona un procedimiento único para las "boletas militares" en los votos del distrito escolar. Mientras que el/la votante debe recibir las boletas de voto en ausencia por correo, un/a votante militar puede optar por recibir su solicitud y boleta de voto en ausencia por correo, correo electrónico o fax. Si un/a votante militar no designa una preferencia, la junta de educación enviará la solicitud de votación militar o la boleta militar por correo. Si un/a votante militar designa una preferencia por transmisión facsímil o correo electrónico, pero no proporciona el número de facsímil o dirección de correo electrónico necesarios, la junta de educación enviará la solicitud de registro de votantes, la solicitud de boleta militar o la boleta militar por correo y solicitará la información omitida. Sin embargo, el votante militar debe devolver su solicitud original de boleta militar y su boleta militar por correo o en persona, independientemente de cómo se haya recibido la solicitud o la boleta de voto en ausencia. La Secretaria de la Junta enviará la boleta militar del votante militar de acuerdo con el método de envío preferido por el/la votante militar o, si no hay preferencia, por correo, a más tardar el 26 de noviembre de 2021. La Secretaria de la Junta debe recibir la boleta de voto militar del votante militar por correo no más tarde de las 5:00 de la tarde del día de la votación.

Sólo los votantes cualificados que están registrados para votar podrán votar.
