PUBLIC NOTICE is hereby given that the Board of Trustees of the Village of Port Chester, New York, having duly convened on August 16, 2022 adopted Local Law No, 10 of the Year 2022, entitled “A LOCAL LAW AMENDING THE CODE OF THE VILLAGE OF PORT CHESTER, CHAPTER 345, “ZONING” IMPOSING A TEMPORARY DEVELOPMENT MORATORIUM ON LAND USE REVIEW AND APPROVAL REGARDING PROJECTS AND APPLICATIONS WITH A RESIDENTIAL COMPONENT, BE THEY EXISTING OR PROPOSED, FOR PROPERTIES IN THE CD-4 GENERAL URBAN CHARACTER DISTRICT, an abstract which is hereto annexed.
Said Local Law amends the Code of the Village of Port Chester, New York, and shall take effect immediately upon due publication and filing with the Secretary of State.
This Notice is published in the official newspaper designated by resolution of the Board of Trustees. A printed copy thereof shall be conspicuously posted as required by law. The Local Law shall be entered in the Minutes of the Board of Trustees of the Village of Port Chester, New York.

ABSTRACT:
On February 20, 2022, the Board of Trustees adopted Local Law No, 6 of 2022 imposing a ninety-day development moratorium on land use and review approval in the CD-4 General Urban Character District. On May 6, 2022, the Board adopted a resolution extending the moratorium for an additional ninety days from the effective date of the law.
The Board of Trustees thereafter established a CD-4 Study Committee to study the matter and make a report with recommended Code changes. This Committee is actively engaged and is expected to provide a final report in the coming weeks.
With the expiration of the current moratorium, the Board finds that a new development moratorium is necessary to hold the status quo while it continues to undertake its due diligence in determining the appropriate regulations. With the benefit of experience in administering the current moratorium, the Board finds that the scope of the new moratorium should be more narrowly tailored.
Local Law No. 10 of 2020 imposes a ninety-day development moratorium on land use review and approval regarding projects and applications with a residential component, be they existing or proposed, for properties in the CD-4 District. Such moratorium may be extended for an additional ninety days by Board resolution.
During the period of the new moratorium the Department of Planning and Community Development, Planning Commission, Zoning Board of Appeals and/or the Board of Trustees shall not accept, review nor make a determination on any application for a zoning amendment, subdivision, site plan, special exception use, variance or interpretation, or request for Building and Lot Plan Approval with regard to such projects and applications.
On a case-by-case basis, the Board of Trustees may grant an exemption and waive the application of the moratorium to alleviate unnecessary hardship or to protect the public health, safety and welfare.
