2021-2022 VILLAGE OF RYE BROOK TAX

SECOND INSTALLMENT REMINDER

This is a courtesy reminder to all taxpayers whose property is located in the Village of Rye Brook that the second installment of the village tax is due by February 28, 2022. Payments must be POSTMARKED BY THE U S POST OFFICE NO LATER THAN February 28, 2022.  If payment is not received by that date, a mandatory, non-waivable penalty of 2% will be added for the month of March and will increase monthly thereafter. Due to the Covid19 virus, the building is not open to the public.

For your convenience, there are three ways for you to make payments.

1) You may mail your check in the envelope provided.  Be sure to include the second stub of the bill.  If you would like a receipt, mark the appropriate box.  Payments must be postmarked by the US Post office no later than February 28, 2022 to avoid the penalty.

2) You may also drop your payment in the special locked box in front of the building at 222 Grace Church Street, Port Chester. Include the whole bill with your payment. You do not need a stamp. We will mail you a receipt.

3) You may pay on line. You may also pay by credit card (Be advised that there is a fee) You may also pay by electronic transfer (ACH). Check the back of the bill for instructions.

NICHOLAS C. MECCA, being duly sworn, affirms as true, deposes and says under the penalties of perjury as follows:

The above-captioned proceeding is hereby commenced to enforce the payment of delinquent taxes or other lawful charges which have accumulated and become liens against certain property. The parcel to which this proceeding applies is attached hereto and made a part hereof, identified as Schedule A.

PLEASE TAKE NOTICE that on the 6th of January 2022, the Receiver of Taxes, hereinafter the Enforcing Officer of the Town of Rye, pursuant to law, filed with the Clerk of Westchester County, a Petition of Foreclosure against a parcel of real property for unpaid tax liens. Such Petition and Notice of Foreclosure pertains to the parcel on the list attached hereto and made a part hereof.

All persons having or claiming to have an interest in the real property described in such list of delinquent taxes are hereby notified that the filing of such list constitutes the commencement by the Town of Rye of an action and proceeding in the Supreme Court, Westchester County to foreclose each of the tax liens therein described by a foreclosure proceeding in rem. Such action and proceeding is brought against the real property only, and is to foreclose the tax liens described in such list. No personal judgment will be entered herein for such taxes or other legal charges or any part thereof.

This notice is directed to all persons owning or having or claiming to have an interest in the real property described in such list of delinquent taxes. The date and time by which Proposals are to be submitted is March 10, 2022 at 3:00 p.m. local time, after which date and time no proposals will be accepted.

§250-18.2.H.(2)(a) The minimum required single side yard setback is 15 feet. The existing non-conforming single side yard setback is 14.8 feet at the west elevation. The new attached two-car garage is proposed to be setback 5 feet from the side property line at the west elevation. Therefore, a single side yard setback of 10 feet is requested.

§250-18.2.H.(2)(b) The minimum required total of two side yards setback is 40 feet. The applicant is proposing to construct a new attached two-car garage which will result in a total of two side yard setback of 19.8 feet. Therefore, a total of two side yards setback variance of 20.2 feet is requested.

§250-18.2.J.(2) The maximum allowable side height setback ratio is 1.3. The proposed detached two-car garage which will result in a side height setback ratio of 3.6 at the west elevation. Therefore, a side height setback ratio variance of 2.3 is requested.

§250-18.2.F. The maximum allowable gross floor area is 3,749 sq. ft. The existing non-conforming gross floor area is 4,900 sq. ft. The proposed attached two-car garage will result in a gross floor area of 5,580 sq. ft. Therefore, a gross floor area variance of 1,831 square feet is requested.

§250-37.B. The maximum allowable main building coverage is 14%. The existing non-conforming main building coverage is 22.15%. The proposed attached two-car garage will result in a main building Coverage of 25.62%. Therefore, a main building coverage variance of 11.62% is requested.
