2021-2022 VILLAGE OF RYE BROOK TAX
SECOND INSTALLMENT REMINDER
This is a courtesy reminder to all taxpayers whose property is located in the Village of Rye Brook that the second installment of the village tax is due by February 28, 2022. Payments must be POSTMARKED BY THE U S POST OFFICE NO LATER THAN February 28, 2022. If payment is not received by that date, a mandatory, non-waivable penalty of 2% will be added for the month of March and will increase monthly thereafter. Due to the Covid19 virus, the building is not open to the public.
For your convenience, there are three ways for you to make payments.
1) You may mail your check in the envelope provided. Be sure to include the second stub of the bill. If you would like a receipt, mark the appropriate box. Payments must be postmarked by the US Post office no later than February 28, 2022 to avoid the penalty.
2) You may also drop your payment in the special locked box in front of the building at 222 Grace Church Street, Port Chester. Include the whole bill with your payment. You do not need a stamp. We will mail you a receipt.
3) You may pay on line. You may also pay by credit card (Be advised that there is a fee) You may also pay by electronic transfer (ACH). Check the back of the bill for instructions.

BOND RESOLUTION DATED FEBRUARY 22, 2022.
A RESOLUTION AUTHORIZING THE ISSUANCE OF $750,000 BONDS OF THE village of Port Chester, westchester COUNTY, NEW YORK, TO PAY THE COST OF the irving avenue storm drain culvert replacement and repair project, in and FOR SAID village.
WHEREAS, the capital project hereinafter described has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as proposed, will not result in any significant environmental effects; and
WHEREAS, it is now desired to authorize such capital project and it’s financing; NOW, THEREFORE, BE IT
BE IT RESOLVED, by the affirmative vote of not less than two-thirds of the total voting strength of the Board of Trustees of the Village of Port Chester, Westchester County, New York, as follows:
Section 1. For the specific object or purpose of paying the cost of the Irving Avenue storm drain culvert replacement and repair project, in and for the Village of Port Chester, Westchester County, New York, including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, there are hereby authorized to be issued $750,000 bonds of said Village pursuant to the provisions of the Local Finance Law.
Section 2. It is hereby determined that the maximum estimated cost of the aforesaid specific object or purpose is $1,300,000, which specific object or purpose is hereby authorized at said maximum estimated cost, and that the plan of financing thereof is by the issuance of a) the $750,000 bonds of said Village authorized to be issued pursuant to this bond resolution and b) $550,000 unexpended bonds proceeds of said Village previously authorized on May 21, 2018; PROVIDED, HOWEVER, that to the extent that any Federal or State grants-in-aid are received for such specific object or purpose, the amount of bonds to be issued pursuant to this resolution shall be reduced dollar for dollar.
Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty years, pursuant to subdivision 4 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years.
Section 4. The faith and credit of said Village of Port Chester, Westchester County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property of said Village, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable.
Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Village Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Village Treasurer, consistent with the provisions of the Local Finance Law.
Section 6. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Village Treasurer, the chief fiscal officer of such Village. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Village Treasurer shall determine consistent with the provisions of the Local Finance Law.
Section 7. The validity of such bonds and bond anticipation notes may be contested only if:
1) Such obligations are authorized for an object or purpose for which said Village is not authorized to expend money, or
2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or
3) Such obligations are authorized in violation of the provisions of the Constitution.
Section 8. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein.
Section 9. Upon this resolution taking effect, the same shall be published in full or summary form in the official newspaper of said Village for such purpose, together with a notice of the Village Clerk in substantially the form provided in Section 81.00 of the Local Finance Law.
Section 10. Pursuant to the provisions of Section 36.00 of the Local Finance Law, this resolution is adopted subject to permissive referendum.

ABSTRACT:
Since the adoption of the new Form-Based Zoning Code, it is evident that the CD-4 General Urban Character District warrants special study and review. The local law imposes a ninety-day moratorium during which time the Planning Commission, Zoning Board of Appeals and/or the Board of Trustees shall not accept, review nor make a determination on any application for a zoning amendment, residential subdivision, site plan, special exception use, variance or interpretation, nor a request for Building and Lot Plan Approval. In the exercise of its legislative discretion, the Board of Trustees may, on application, grant an exemption and waive the application of the moratorium to alleviate unnecessary hardship or to protect the public health, safety and welfare.

The Owner is the Village of Port Chester and the work site is/are located in the Village of Port Chester. The projects limits are located within six locations throughout the Village. The work is located at the intersections of: S. Regent Street & William Street, Abendroth Avenue & Mill Street, Abendroth Avenue & Adee Street, Abendroth Avenue & Willett Avenue, East Broadway Corridor, and Purdy Avenue & Waterfront Place
The work includes providing all labor, materials, machinery, tools, equipment and other means of construction necessary and incidental to the completion of the work shown on the plans and described in these specifications including, but not necessarily limited to the following: construction of ADA compliant sidewalks and curb ramps, pavement striping, installation of a new pedestrian traffic signals, and curb extensions where the existing roadways are wide a feature travel lanes and parking lanes in the Village of Port Chester, Westchester County, New York.
This is a Federal Aid Project and NYSDOT Standard Specifications, officially finalized and adopted as posted on the New York State Department of Transportation’s website must be followed by the successful bidder.
The DBE Utilization goal for this project is 10%. The EEO Employment goals for this project are: 22.6% Minority Employment Goal, and 6.9% Women Employment Goal.

No residential or geographical restrictions will be in effect for this project. Applicable Federal requirements take precedence over State and local requirements unless state and local requirements are deemed to be more stringent.

No questions or inquiries regarding this bid will be accepted within seven (7) business days prior to the bid opening.
Contractors that obtain Contract Documents from a source other than the issuing office must notify the issuing office in order to be placed on the official Plan Holder List, to receive Addenda and any other Bid correspondence. Bids received from Contractors other than those on the official Plan Holders List will not be accepted.
Addenda will be emailed from Barton & Loguidice, D.P.C. to Bidders listed on the official Plan Holders List. An emailed response from the Bidder, to the Addendum sent by Barton & Loguidice, D.P.C. will act as proof that the Bidder received the Addendum. In addition to an emailed response, Bidders must acknowledge receipt of all Addenda by signing and dating each Addendum of the Bid Form and the Acknowledgement of Receipt of Addenda. Failure of any Bidder to receive any such Addendum or interpretation shall not relive such Bidder from any obligation under this Bid submittal. All Addenda so issued shall become part of the Contract Documents.
Questions regarding the Contract Documents should be directed to the project engineer, Barton & Loguidice, D.P.C., as noted below. Bidders shall promptly notify the engineer of any errors, omissions, conflicts or ambiguity within the Contract Documents immediately.
All bids must include the completed Bid Form, Non-Collusive Bidding and Disbarment Certifications, and Lobbying Certifications. This is a unit price bid as described in the Instructions to Bidders. No bidder may withdraw his/her bid within forty-five (45) calendar days after the actual date of the opening thereof.
Each bid must be accompanied by security in an amount not less than five percent (5%) of the amount of the bid in the form and subject to the conditions provided in the Instructions to Bidders.
One hard-copy and one electronic version of the proposal on a flash drive shall be provided. Bids to be considered must be received in a sealed envelope by the Village Clerk: Village of Port Chester, 222 Grace Church Street, Port Chester, NY 10573 by 3:00pm, local time, on March 24, 2022 at which time they will be publicly opened and read aloud. Bids received after the above noted time will not be accepted. All sealed envelopes should be clearly labeled “BID: PIN 8762.08 – PORT CHESTER PEDESTRIAN SAFETY ACTION PLAN”.
The Bidder to whom the Contract is awarded will be required to furnish Performance, Payment and Guarantee Bonds from an acceptable Surety Company for an amount not less than 100% of the accepted bid. The successful Bidder and all subcontractors must have an approved CCA-2 on file with NYSDOT prior to being awarded a contract. If the successful Bidder does not currently have a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instruction for completion online at https://osc.state.ny.us/venrep/form_cca2.htm.
The successful Bidder will be required to comply with all provisions of the Federal Government Equal Employment Opportunity clauses issued by the Secretary of Labor on May 2, 1968, and published in the Federal Register (41 CFR Part 60-1, 33 F.2 7804). Successful bidders will be required to pay prevailing wage rates on this contract.
The Village of Port Chester reserves the right to consider the bids for forty-five (45) days after receipt before awarding any Contract, and to waive any minor informalities in, and to reject, any and all bids or to accept the one that in its judgment will be for the best interest of the Village of Port Chester. All bids are subject to final review and approval by the New York State Department of Transportation before any award of contract may be made. Receipt of bids by the Village of Port Chester shall not be construed as authority to bind the Village of Port Chester.
The work shall be completed 120 calendar days from Notice to Proceed and ready for final payment by November 1, 2022 unless such period is extended by the Village of Port Chester as provided herein. Notice to Proceed is expected to be issued in June of 2022.
