A nonprofit organization in Westchester, NY is seeking sealed bids for sales and installation of security related enhancements. This is a New York State Division of Homeland Security and Emergency Services grant funded project. The project includes (i) installation of one or more: technology (such as CCTV, access control, alarms, sensors, X-ray machines, magnetometer), security film, doors, locks, windows, bollards, booth, planters, barriers, lighting, fencing, privacy fencing, gates, (ii) training programs, and (iii) security personnel. BID # 2022-11 / PIN 8762.08 - PORT CHESTER PEDESTRIAN SAFETY ACTION PLAN
The Owner is the Village of Port Chester and the work site is/are located in the Village of Port Chester. The projects limits are located within six locations throughout the Village. The work includes providing all labor, materials, machinery, tools, equipment and other means of construction necessary and incidental to the completion of the work shown on the plans and described in these specifications including, but not necessarily limited to the following:
Base Bid: Abendroth Corridor Improvements includes construction of ADA compliant sidewalks and curb ramps, pavement striping, installation of a new pedestrian traffic signals, and curb extensions at the intersections of Abendroth Avenue & Mill Street, Abendroth Avenue & Adee Street, Abendroth Avenue & Willett Avenue, and East Broadway & Westchester Avenue.
Alternate Bid No. 1: Purdy Avenue & Waterfront Place Improvements includes construction of ADA compliant sidewalks and curb ramps, pavement striping, installation of a new pedestrian traffic signals, and curb extensions at the intersection of Purdy Avenue & Waterfront Place.
Alternate Bid No. 2: S. Regent Street & William Street Improvements includes construction of ADA compliant sidewalks and curb ramps and pavement striping at the intersection of S. Regent Street & William Street.
Alternate Bid No. 3: Abendroth Avenue & Willett Avenue Flashing Beacons includes the furnishing and installation of concrete foundations and the assembly of Village supplied solar powered rectangular rapid flashing beacons at the intersection of Abendroth Avenue and Willett Street.
One hard-copy and one electronic version of the proposal on a flash drive shall be provided. Bids submitted without the proposal on a flash drive will be rejected. This is a Federal Aid Project and NYSDOT Standard Specifications, officially finalized and adopted as posted on the New York State Department of Transportation’s website must be followed by the successful bidder.
The DBE Utilization goal for this project is 10%. The EEO Employment goals for this project are: 22.6% Minority Employment Goal, and 6.9% Women Employment Goal.

No residential or geographical restrictions will be in effect for this project. Applicable Federal requirements take precedence over State and local requirements unless state and local requirements are deemed to be more stringent.

No questions or inquiries regarding this bid will be accepted within seven (7) business days prior to the bid opening.
Contractors that obtain Contract Documents from a source other than the issuing office must notify the issuing office in order to be placed on the official Plan Holder List, to receive Addenda and any other Bid correspondence. Bids received from Contractors other than those on the official Plan Holders List will not be accepted.
Addenda will be emailed from Barton & Loguidice, D.P.C. to Bidders listed on the official Plan Holders List. An emailed response from the Bidder, to the Addendum sent by Barton & Loguidice, D.P.C. will act as proof that the Bidder received the Addendum. In addition to an emailed response, Bidders must acknowledge receipt of all Addenda by signing and dating each Addendum of the Bid Form and the Acknowledgement of Receipt of Addenda. Failure of any Bidder to receive any such Addendum or interpretation shall not relive such Bidder from any obligation under this Bid submittal. All Addenda so issued shall become part of the Contract Documents.

All bids must include the completed Bid Form, Non-Collusive Bidding and Disbarment Certifications, and Lobbying Certifications. This is a unit price bid as described in the Instructions to Bidders. No bidder may withdraw his/her bid within forty-five (45) calendar days after the actual date of the opening thereof.
Each bid must be accompanied by security in an amount not less than five percent (5%) of the amount of the bid in the form and subject to the conditions provided in the Instructions to Bidders.
The Bidder to whom the Contract is awarded will be required to furnish Performance, Payment and Guarantee Bonds from an acceptable Surety Company for an amount not less than 100% of the accepted bid. The successful Bidder and all subcontractors must have an approved CCA-2 on file with NYSDOT prior to being awarded a contract. If the successful Bidder does not currently have a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instruction for completion online at https://osc.state.ny.us/venrep/form_cca2.htm.
The successful Bidder will be required to comply with all provisions of the Federal Government Equal Employment Opportunity clauses issued by the Secretary of Labor on May 2, 1968, and published in the Federal Register (41 CFR Part 60-1, 33 F.2 7804). Successful bidders will be required to pay prevailing wage rates on this contract.
The Village of Port Chester reserves the right to consider the bids for forty-five (45) days after receipt before awarding any Contract, and to waive any minor informalities in, and to reject, any and all bids or to accept the one that in its judgment will be for the best interest of the Village of Port Chester. All bids are subject to final review and approval by the New York State Department of Transportation before any award of contract may be made. Receipt of bids by the Village of Port Chester shall not be construed as authority to bind the Village of Port Chester.
The work shall be completed 90 calendar days from Notice to Proceed and ready for final payment by November 1, 2022 unless such period is extended by the Village of Port Chester as provided herein. Notice to Proceed is expected to be issued in July of 2022.

In exercising such authority, the Village Board of Trustees duly adopted a resolution to transfer the conduct of the Village Election to the Westchester County Board of Elections, subject to a permissive referendum as provided by the provisions of the Article 9 of the Village Law.

BOND RESOLUTION DATED MAY 2, 2022.
A RESOLUTION AUTHORIZING THE ISSUANCE OF $1,050,000 BONDS OF THE village of Port Chester, westchester COUNTY, NEW YORK, TO PAY THE COST OF the police radio system upgrade, in and FOR SAID village.
WHEREAS, the capital project hereinafter described has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as proposed, will not result in any significant environmental effects; and
WHEREAS, it is now desired to authorize such capital project and its financing; NOW, THEREFORE, BE IT
BE IT RESOLVED, by the affirmative vote of not less than two-thirds of the total voting strength of the Board of Trustees of the Village of Port Chester, Westchester County, New York, as follows:
Section 1. For the specific object or purpose of paying the cost of the police radio system upgrade, in and for the Village of Port Chester, Westchester County, New York, including incidental equipment and expenses in connection therewith, there are hereby authorized to be issued $1,050,000 bonds of said Village pursuant to the provisions of the Local Finance Law.
Section 2. It is hereby determined that the maximum estimated cost of the aforesaid specific object or purpose is $1,050,000, which specific object or purpose is hereby authorized at said maximum estimated cost, and that the plan of financing thereof is by the issuance of the $1,050,000 bonds of said Village authorized to be issued pursuant to this bond resolution.
Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is ten years, pursuant to subdivision 25 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years.
Section 4. The faith and credit of said Village of Port Chester, Westchester County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property of said Village, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable.
Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Village Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Village Treasurer, consistent with the provisions of the Local Finance Law.
Section 6. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Village Treasurer, the chief fiscal officer of such Village. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Village Treasurer shall determine consistent with the provisions of the Local Finance Law.
Section 7. The validity of such bonds and bond anticipation notes may be contested only if:
1) Such obligations are authorized for an object or purpose for which said Village is not authorized to expend money, or
2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or
3) Such obligations are authorized in violation of the provisions of the Constitution.
Section 8. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein.
Section 9. Upon this resolution taking effect, the same shall be published in full or summary form in the official newspaper of said Village for such purpose, together with a notice of the Village Clerk in substantially the form provided in Section 81.00 of the Local Finance Law.
Section 10. Pursuant to the provisions of Section 36.00 of the Local Finance Law, this resolution is adopted subject to permissive referendum.

NOTICE IS HEREBY GIVEN that a Public Budget Hearing of the Blind Brook-Rye Union Free School District shall be held on Tuesday, May 10, 2022 at 7:30 o’clock in the evening in the Monroe E. Haas IMC at Blind Brook Middle/High School on King Street, Rye Brook, New York, for the purpose of discussion of the expenditure of funds and budgeting thereof;

AND FURTHER NOTICE IS HEREBY GIVEN, that a copy of the detailed statement in writing of the amount of money which will be required for the school year 2022-2023 for school purposes, specifying the several purposes and the amount of each (2022-2023 budget) as provided by Section 1716 of the Education Law may be obtained by any taxpayer in the District between the hours of 9:00 o’clock in the forenoon and 3:00 o’clock in the afternoon beginning May 3, 2022 and thereafter, except Saturday, Sunday or holidays, in the Main Office at the Bruno M. Ponterio Ridge Street School, North Ridge Street, Rye Brook, New York and the Main Office at the Blind Brook Middle/High School, King Street, Rye Brook, New York, and at the Public Hearing to be held as aforesaid on May 10, 2022;
AND FURTHER NOTICE IS HEREBY GIVEN that any other proposition not requiring official notice in the call of the Annual Meeting may be voted upon at said election, subject to the provisions of Section 2035 of the Education Law, provided a proposition is filed with the District Clerk on or before March 18, 2022 at 5:00 p.m. prevailing time; said proposition must be typed or printed in the English language; must be directed to the Clerk of the School District; must be signed by at least twenty-five (25) qualified voters of the District; and must state the name and residence of each signer. The School Board will not entertain any petition to place before the voters any proposition the purpose of which is not within the powers of the voters to determine, or any proposition which fails to include a specific appropriation where the expenditure of monies is required by the proposition.
AND FURTHER NOTICE IS HEREBY GIVEN, that applications for absentee ballots will be obtainable from the District Clerk beginning April 18, 2022. Completed applications must be received by the District Clerk no later than May 10, 2022 if the ballot is to be mailed to the voter or May 16, 2022 if the ballot is to be personally delivered to the voter. All absentee ballots must be received in the Clerk’s office by 5:00 p.m. on the day of the election. A list of all persons to whom absentee ballots shall have been issued will be available in said office of the Clerk on each of the five (5) days prior to the day of the election except Sunday, and such list shall also be posted at the polling place or places at the election of members of the Board of Education. Any qualified voter present in the polling place may object to the voting of the ballot upon appropriate grounds for making his/her challenge and the reasons therefor known to the Inspector of Election before the close of the polls.
AND FURTHER NOTICE IS HEREBY GIVEN, that Education Law makes special provisions for absentee voting by “permanently disabled” voters of the District and any questions regarding these rights should be directed to the Clerk of the Board. All completed ballots shall be mailed to the Office of the District Clerk no later than 5:00 p.m. on May 17, 2022.
AND FURTHER NOTICE IS HEREBY GIVEN, that military voters who are not currently registered may apply to register as a qualified voter of the Blind Brook-Rye Union Free School District. A military voter registration application may be requested from the Board of Education at 390 North Ridge Street, Rye Brook, New York and must be returned to the Office of the District Clerk at 390 North Ridge Street, Rye Brook, New York not later than 5:00 pm on April 21, 2022. A military voter may indicate their preference for receiving the registration application by mail, facsimile transmission, or email.
AND FURTHER NOTICE IS HEREBY GIVEN, that Education Law also makes special provisions for absentee voting for “military” voters of the District. Specifically, the law provides a unique procedure for “military ballots” in school district votes. Whereas absentee ballots must be received by the voter by mail, a military voter may elect to receive his/her absentee ballot application and absentee ballot by mail, email or facsimile. If a military voter does not designate a preference, the board of education shall transmit the military ballot application or military ballot by mail. If a military voter designates a preference for facsimile transmission or electronic mail but does not provide the necessary facsimile number or e-mail address, the board of education shall transmit the voter registration application, military ballot application or military ballot by mail and request the omitted information. The military voter must, however, return his/her original military ballot application and military ballot by mail or in person, regardless of how the absentee application or ballot was received. The Clerk of the Board shall transmit the military voter’s military ballot in accord with the military voter’s preferred method of transmission, or if not preference by mail, not later than April 21, 2022. The Clerk of the Board must then receive the military voter’s military ballot by mail not later than 5:00 p.m. on the day of the vote.

POR LA PRESENTE SE AVISA que se llevará a cabo una Audiencia de Presupuesto Pública del Distrito Escolar Blind Brook-Rye Union Free el martes 10 de mayo de 2022 a las 7:30 de la tarde en el Centro de Instrucción de medios de comunicación (IMC por sus siglas en inglés) Monroe E. Haas en las escuelas media/secundaria de Blind Brook, en King Street, Rye Brook, Nueva York, con el propósito de tratar el gasto de fondos y el presupuesto de los mismos;
Y POR LA PRESENTE ADEMÁS SE AVISA que la elección anual de la Junta de Educación se llevará a cabo el martes 17 de mayo de 2022 entre las 7:00 de la mañana y las 9:00 de la noche de dicho día, en el gimnasio del edificio principal de la Escuela Bruno M. Las solicitudes llenadas deben ser recibidas por la Secretaria de Distrito a más tardar el 10 de mayo de 2022 si la boleta se va a enviar por correo a los votantes o el 16 de mayo de 2022 si la boleta se entregará personalmente a los votantes. Y POR LA PRESENTE ADEMÁS SE AVISA, que la Ley de Educación establece disposiciones especiales para el voto en ausencia por parte de los votantes "permanentemente discapacitados" del Distrito y cualquier pregunta respecto a estos derechos debe dirigirse a la Secretaria de la Junta. Todas las boletas debidamente llenadas se enviarán por correo a la Oficina de la Secretaria de Distrito a más tardar a las 5:00 de la tarde, el 17 de mayo de 2022.
Y POR LA PRESENTE ADEMÁS SE AVISA, que los votantes militares que no están registrados actualmente pueden solicitar registrarse como votantes cualificados del Distrito Escolar Blind Brook-Rye Union Free. Y POR LA PRESENTE ADEMÁS SE AVISA, que la Ley de Educación también establece disposiciones especiales para el voto en ausencia para los votantes "militares" del Distrito. Específicamente, la ley proporciona un procedimiento único para las "boletas militares" en los votos del distrito escolar. Mientras que el/la votante debe recibir las boletas de voto en ausencia por correo, un/a votante militar puede optar por recibir su solicitud y boleta de voto en ausencia por correo, correo electrónico o fax. Si un/a votante militar no designa una preferencia, la junta de educación enviará la solicitud de votación militar o la boleta militar por correo. Si un/a votante militar designa una preferencia por transmisión facsímil o correo electrónico, pero no proporciona el número de facsímil o dirección de correo electrónico necesarios, la junta de educación enviará la solicitud de registro de votantes, la solicitud de boleta militar o la boleta militar por correo y solicitará la información omitida. No obstante, el votante militar debe devolver su solicitud original de boleta militar y su boleta militar por correo o en persona, independientemente de cómo se haya recibido la solicitud o la boleta de voto en ausencia. La Secretaria de la Junta enviará la boleta militar del votante militar de acuerdo con el método de envío preferido por el/la votante militar, o si no hay preferencia, por correo, a más tardar el 21 de abril de 2022. La secretaria de la Junta debe recibir la boleta de voto militar del votante o la votante militar por correo, no más tarde de las 5:00 de la tarde del día de la votación.
