ABSTRACT:

Local Law No. I-19 of 2022 is a companion to Local Law I-18 of 2022 making certain text changes to Chapter 345 of the Zoning Code.

This local law amends the zoning designation of certain properties currently designated as CD-4 General Urban District to variously a C1 Neighborhood Character District, CD4-MU Mixed Use Character District and an R2F Two Family Residence District, change certain properties currently designated as in a CD-6 District to a CD4 Mixed Use District and to extend the CD-3 R5 Single Family Residence designation to certain properties currently designated in the CD-4 District all as shown on the new Official Zoning Map (copy attached).

ABSTRACT:

Pursuant to Local Law No. 4 of 2020 adopted on May 20, 2020, and following an extensive, publicly inclusive visioning process, the Board of Trustees enacted a new “form-based” Zoning Code. Unlike some other municipalities that have adopted form-based zoning as an overlay district to cover specific areas such as downtowns, commercial corridors or neighborhoods, Port Chester’s new Zoning Code was a far-reaching effort covering the entire village.

Since the adoption of the Zoning Code, practical application and experience has shown that a single character district, the CD-4 District, warranted proactive special study and review. The CD-4 District comprises the largest mapped physical area of all the zoning districts.

The Board established an advisory CD-4 Review Committee comprised of village residents and property owners to study the CD-4 District and return with a report with recommendations for proposed legislation. On October 17, 2022, the Committee made a public presentation to the Board of Trustees and provided a written report recommending significant changes to the Official Zoning Map and related text changes to the Zoning Code.

The Board concurred with the Committee’s report in finding that the CD-4 District should be modified to establish a new C1 Neighborhood Character District and new R2F Two-Family District with related dimensional and use text changes to the CD-4 General Urban Character District, but also on its own initiative determined to establish a new CD4-MU General Urban Mixed Use District.

The Board found and declared that the local law making text changes and the companion local law, Local Law No. 19 of 2022, making changes to the Zoning Map are necessary and appropriate so as to more fully implement to the general goals and objectives of the Zoning Code.

The Board expressed its intent to continue the process of reviewing the Zoning Code with a goal of further amendment as need be.

2023 COUNTY & TOWN TAX NOTICE

This is a notice to all taxpayers whose property is located in the Village of Port Chester, the Village of Rye Brook, or the Rye Neck section of the Village of Mamaroneck that the 2023 Westchester County & Town of Rye tax is due. Payment must be received by April 30, 2023. Payments must be POSTMARKED BY THE U.S. POST OFFICE NO LATER THAN April 30, 2023. If payment is not received by that date, a mandatory, non-waivable penalty of 2% will be added for the month of May and will increase monthly thereafter. Please take note that because the 30th falls on Sunday, payments will be accepted on Monday, May 1st. Then the penalty is applied after May 1.

For your convenience, there are three ways for you to make payments.

1. You can mail your check in the envelope provided. Be sure to include the bottom portion of the bill. If you would like a receipt, mark the appropriate box on the stub. Payments must be postmarked by the US Post Office no later than April 30, 2023 to avoid the penalty. Due to mail processing changes that have added time to the delivery process, we request that you mail you payments a few days earlier.

2. You may also drop your payment in the special locked box in front of the building at 222 Grace Church Street, Port Chester. Include the whole bill with your payment, no stamp required.

3. You may pay on line. You may pay by credit card. Be advised that the credit card process has a fee of 2.35%.

You may also pay by electronic transfer (ACH) that carries a fee of $1.50. Check the back of the bill for instructions.

ABSTRACT:

On April 29, 2019, the Planning Commission of the Village of Port Chester granted site plan and special exception use approvals for the “Station Lofts” multifamily residential project to be located at 67 New Broad Street, which approvals were granted prior to the enactment of the current Firm Based Zoning Code.

Construction of the project has been delayed as a result of certain impediments, including the ongoing impacts of the COVID-19 pandemic, negotiations with the Metropolitan Transportation Authority (MTA) and Veolia for necessary permits and approvals to allow for construction of the project.

To account for the cumulative effect of the foregoing delays, Local Law No. I-01 of the Year 2023 further extends the site plan approval and all related approvals for the Station Lofts Project from April 28, 2023 through and including December 31, 2025.

NOTICE IS HEREBY GIVEN that a Public Budget Hearing of the Blind Brook-Rye Union Free School District shall be held on Tuesday, May 2, 2023 at 7:30 o’clock in the evening in the Monroe E. AND FURTHER NOTICE IS HEREBY GIVEN that the annual election of the Board of Education be held on Tuesday, May 16, 2023 between the hours of 7:00 o’clock in the forenoon and 9:00 o’clock in the evening of said day, in the main building Cafetorium of the Bruno M. AND FURTHER NOTICE IS HEREBY GIVEN, that personal registration of qualified voters is required either pursuant to the Education Law or Election Law. If a voter has heretofore registered pursuant to Education Law §2014 and has voted at an annual or special District meeting within the last four (4) calendar years, he/she is eligible to vote at this election; if a voter is registered and eligible to vote under Article 5 of the Election Law, he/she is also eligible to vote at this election. AND FURTHER NOTICE IS HEREBY GIVEN, that applications for absentee ballots are available at the District Office or on the District website (www.blindbrook.org) and may be submitted to the District Clerk no earlier than thirty (30) days before the election April 17, 2023. Completed applications must be received by the District Clerk no later than May 9, 2023 if the ballot is to be mailed to the voter or May 15, 2023 if the ballot is to be personally delivered to the voter. All absentee ballots must be received in the Clerk’s office by 5:00 p.m. on the day of the election. A list of all persons to whom absentee ballots shall have been issued will be available in said office of the Clerk on each of the five (5) days prior to the day of the election except Sunday, and such list shall also be posted at the polling place or places at the election of members of the Board of Education. Any qualified voter present in the polling place may object to the voting of the ballot upon appropriate grounds for making his/her challenge and the reasons therefor known to the Inspector of Election before the close of the polls.

 AND FURTHER NOTICE IS HEREBY GIVEN, that Education Law makes special provisions for absentee voting by “permanently disabled” voters of the District and any questions regarding these rights should be directed to the Clerk of the Board. All completed ballots shall be mailed to the Office of the District Clerk no later than 5:00 p.m. on May 16, 2023.

AND FURTHER NOTICE IS HEREBY GIVEN, that military voters who are not currently registered may apply to register as a qualified voter of the Blind Brook-Rye Union Free School District. A military voter registration application may be requested from the Board of Education at 390 North Ridge Street, Rye Brook, New York and must be returned to the Office of the District Clerk at 390 North Ridge Street, Rye Brook, New York not later than 5:00 pm on April 20, 2023. A military voter may indicate their preference for receiving the registration application by mail, facsimile transmission, or email.

 AND FURTHER NOTICE IS HEREBY GIVEN, that Education Law also makes special provisions for absentee voting for “military” voters of the District. Specifically, the law provides a unique procedure for “military ballots” in school district votes. Whereas absentee ballots must be received by the voter by mail, a military voter may elect to receive his/her absentee ballot application and absentee ballot by mail, email or facsimile. If a military voter does not designate a preference, the board of education shall transmit the military ballot application or military ballot by mail. If a military voter designates a preference for facsimile transmission or electronic mail but does not provide the necessary facsimile number or e-mail address, the board of education shall transmit the voter registration application, military ballot application or military ballot by mail and request the omitted information. The military voter must, however, return his/her original military ballot application and military ballot by mail or in person, regardless of how the absentee application or ballot was received. The Clerk of the Board shall transmit the military voter’s military ballot in accord with the military voter’s preferred method of transmission, or if not preference by mail, not later than April 21, 2023. The Clerk of the Board must then receive the military voter’s military ballot by mail not later than 5:00 p.m. on the day of the vote.

"¿Se autorizará a la Junta de Educación del Distrito Escolar ("Distrito") de Blind Brook-Rye Union Free a establecer un nuevo Fondo de Reserva de Capital de conformidad con las disposiciones de la sección 3651 de la Ley de Educación, que se denominará "Fondo de Reserva de la Flota de Autobuses del Distrito Escolar Blind Brook-Rye Union Free - 2022" (el "Fondo") a partir del 17 de mayo de 2023, con el propósito de proporcionar dinero para la compra directa de autobuses escolares, lo que se sumará a la flota de autobuses del Distrito que incluye, pero no se limita a, la financiación total o parcial, suplementar y/o reemplazar la flota de autobuses del Distrito, incluidos el equipo original, la maquinaria, los aparatos, los accesorios originales, así como los honorarios para el manejo del proyecto, los trabajos auxiliares o relacionados requeridos en relación con el mismo; el plazo probable de dicho Fondo no superará los diez (10) años a partir de la fecha de su creación; el monto principal final del mismo ascenderá a un total de ocho (8) millones de dólares más los ingresos por intereses correspondientes; dicha cantidad se proporcionará con el excedente de dinero que queda en el fondo general y/o de reservas existentes en el año fiscal actual y años futuros, y los intereses devengados por dichos fondos a lo largo de la vigencia del fondo de reserva de capital, suficientes para financiar dicha cantidad de capital final?"

4. Establecer un Fondo de Reserva de Capital - Fondo de Reserva de Capital – 2022

«¿Se autorizará a la Junta de Educación del Distrito Escolar Blind Brook-Rye Union Free ("Distrito») a establecer un nuevo Fondo de Reserva de Capital de conformidad con las disposiciones de la sección 3651 de la Ley de Educación, que se denominará "Fondo de Reserva de Capital - 2022» (el "Fondo") a partir del 17 de mayo de 2023, con el fin de proporcionar dinero para futuras mejoras de capital para proyectos de edificios y mejora del sitio en varios edificios escolares, incluidos, entre otros, gastos de propiedad y de edificios y reformas que incluyen los muebles originarios, el equipo, la maquinaria, los aparatos, los accesorios originales, así como los honorarios de arquitectura y manejo del proyecto, las obras auxiliares o trabajo relacionado requerido en relación con los mismos; el plazo probable de dicho Fondo no superará los diez (10) años a partir de la fecha de su creación; el importe principal final del mismo ascenderá a un total de quince (15) millones de dólares más los ingresos por intereses correspondientes; dicha cantidad se proporcionará con el excedente de dinero restante en el fondo general y/o de las reservas existentes en el año fiscal actual y años futuros y los intereses devengados en dichos fondos durante la vigencia del fondo de reserva de capital, suficientes para financiar dicho importe de capital final?

Y ADEMÁS SE AVISA, que se requiere el registro personal de los votantes cualificados, ya sea de conformidad con la Ley de Educación o la Ley Electoral. Si un/a votante se ha registrado hasta ahora conforme al artículo 2014 de la Ley de Educación y ha votado en una reunión anual o especial del distrito dentro de los últimos cuatro (4) años calendario, él o ella tiene derecho a votar en esta elección. Si un/a votante está registrado/a y cumple los requisitos para votar conforme al artículo 5 de la Ley Electoral, él o ella también tiene derecho a votar en esta elección. Todas las demás personas que deseen votar deben registrarse en la Oficina de la Secretaria del Distrito de la escuela Bruno M. Ponterio Ridge Street en la calle North Ridge entre las 4:00 p.m. y las 8:00 p.m. el jueves 11 de mayo de 2023;

Y ADEMÁS SE AVISA, que la Junta de Registro también se reunirá durante las elecciones referidas anteriormente y votará sobre el presupuesto anual y la recaudación de impuestos en la cafetería auditorio (cafetorium) del edificio principal de la escuela Bruno M. Ponterio Ridge Street en la calle North Ridge entre las 7:00 de la mañana y 9:00 de la noche, con el fin de preparar un registro para las elecciones que se celebrarán después de dicha elección;

Y ADEMÁS SE AVISA, que el registro de conformidad con la Sección 2014 de la Ley de Educación se archivará para su inspección en la oficina de la Secretaria del Distrito Escolar en la Escuela Bruno M. Ponterio Ridge Street, North Ridge Street, Rye Brook, Nueva York, y estará abierto a la inspección de cualquier votante cualificado/a del Distrito el 11 de mayo de 2023, entre las 9:00 de la mañana y las 3:00 de la tarde de lunes a viernes, y cada día anterior al día establecido para la elección, excepto el domingo, y en el(los) lugar(es) de votación el día de la votación.

Y ADEMÁS SE AVISA, que una copia de la declaración detallada por escrito de la cantidad de dinero que se requerirá para el año escolar 2023-2024 para fines escolares, especificando los diversos propósitos y la cantidad de cada uno (presupuesto 2023-2024 ) según lo dispuesto por la Sección 1716 de la Ley de Educación, cualquier contribuyente en el Distrito puede obtenerla entre las 9:00 de la mañana y las 3:00 de la tarde a partir del 2 de mayo de 2023 y posteriormente, excepto los sábados, domingos o feriados, en la oficina principal de la escuela Bruno M. Ponterio Ridge Street, North Ridge Street, Rye Brook, Nueva York y la oficina principal de la escuela media/secundaria Blind Brook, King Street, Rye Brook, Nueva York, y en la audiencia pública que se celebrará como se mencionó anteriormente el 9 de mayo de 2023;

Y ADEMÁS SE AVISA que cualquier otra propuesta que no requiera notificación oficial en la convocatoria de la Reunión Anual puede ser votada en dicha elección, sujeto a las disposiciones de la Sección 2035 de la Ley de Educación, siempre que se presente una propuesta ante la Secretaria del Distrito antes de o el 16 de marzo de 2023, a las 5:00 de la tarde, hora vigente; dicha proposición debe ser tipeada o impresa en inglés; debe ser dirigida a la secretaria del distrito escolar; debe estar firmada por al menos veinticinco (25) votantes cualificados del Distrito; y debe indicar el nombre y la residencia de cada firmante. La Junta Escolar no aceptará ninguna petición para presentar ante los votantes alguna proposición cuyo propósito no esté dentro del poder de los votantes para determinar, o cualquier proposición que no incluya una apropiación específica donde el gasto de dinero es requerido por la proposición.

Y ADEMÁS SE AVISA que las solicitudes de boletas de voto en ausencia están disponibles en la Oficina del Distrito o en el sitio web del Distrito (www.blindbrook.org) y pueden presentarse a la Secretaria del Distrito no antes de treinta (30) días antes de las elecciones, el 17 de abril de 2023. La Secretaria del Distrito debe recibir las solicitudes completas a más tardar el 9 de mayo de 2023 si la boleta se enviará por correo al votante o el 15 de mayo de 2023 si la boleta se entregará personalmente a los votantes. Todas las boletas de voto en ausencia deben recibirse en la oficina de la Secretaria antes de las 5:00 p.m.del día de la elección. Una lista de todas las personas a quienes se les habrá emitido votos en ausencia estará disponible en dicha oficina de la Secretaria cada uno de los cinco (5) días antes del día de la elección, excepto el domingo, y dicha lista también se publicará en el lugar o lugares de votación a elección de los miembros de la Junta de Educación. Cualquier votante cualificado/a presente en el lugar de votación puede oponerse a la votación de la boleta electoral con motivos pertinentes para presentar su impugnación y las razones y hacerlas saber al Inspector de Elecciones antes del cierre de los centros de votación.

Y ADEMÁS SE AVISA, que la Ley de Educación establece disposiciones especiales para el voto en ausencia por parte de los votantes "permanentemente discapacitados" del Distrito y cualquier pregunta sobre estos derechos debe dirigirse a la Secretaria de la Junta. Todas las boletas debidamente llenadas se enviarán por correo a la Oficina de la Secretaria de Distrito no más tarde de las 5:00 p.m. el 16 de mayo de 2023.

Y ADEMÁS SE AVISA, que los votantes militares que no están registrados actualmente pueden solicitar registrarse como un/a votante cualificado/a del Distrito Escolar Blind Brook-Rye Union Free. Una solicitud de registro de votantes militares puede ser solicitada a la Junta de Educación en 390 North Ridge Street, Rye Brook, Nueva York y debe ser devuelta a la Oficina de la Secretaria de Distrito en 390 North Ridge Street, Rye Brook, Nueva York no más tarde de las 5:00 p.m. el 20 de abril de 2023. El/la votante militar puede indicar su preferencia de recibir la solicitud de registro por correo, fax o correo electrónico.

Y ADEMÁS SE AVISA, que la Ley de Educación también establece disposiciones especiales para el voto en ausencia para los votantes "militares" del Distrito. Específicamente, la ley proporciona un procedimiento único para las "boletas militares" en los votos del distrito escolar. Mientras que el/la votante debe recibir las boletas de voto en ausencia por correo, un/a votante militar puede optar por recibir su solicitud y boleta de voto en ausencia por correo, correo electrónico o fax. Si un/a votante militar no designa una preferencia, la junta de educación enviará la solicitud de votación militar o la boleta militar por correo. Si un/a votante militar designa una preferencia por transmisión facsímil o correo electrónico, pero no proporciona el número de facsímil o dirección de correo electrónico necesarios, la junta de educación enviará la solicitud de registro de votantes, la solicitud de boleta militar o la boleta militar por correo y solicitará la información omitida. Sin embargo, el(la) votante militar debe devolver su solicitud original de boleta militar y su boleta militar por correo o en persona, independientemente de cómo se haya recibido la solicitud o la boleta de voto en ausencia. La Secretaria de la Junta enviará la boleta militar del votante militar de acuerdo con el método de envío preferido por el/la votante militar, o si no hay preferencia por correo, a más tardar el 21 de abril de 2023. La secretaria de la Junta debe recibir la boleta de voto militar del votante militar por correo no más tarde de las 5:00 p.m. del día de la votación.
