BID NOTICE


The Town of Rye, New York, hereby gives notice that General Contractor’s sealed bids will be received in the office of the Town Clerk for:


Recreation Field and Associated Work at Crawford Park, Rye Brook, NY


Contract Documents:  The Contract Documents are available electronically by contacting Arconics Architecture, PC at (914) 937-5596 Ext. 104. Prospective bidders must provide a specific company contact name, email and phone number.


TIME: Sealed bids will be received by the Town of Rye at 222 Grace Church Street, Port Chester, NY 10573 in the Town Clerk’s office until 11:00 AM local time, on Friday, October 6, 2023.  Bids will be publicly opened and read aloud at that time in the Supervisor’s Office.


BIDS: All bids shall be addressed to the attention of the Town Clerk, Town of Rye, 222 Grace Church Street, Port Chester, NY 10573, and shall be enclosed, with the name and address of the Bidder and name of the project shown on the outside of the sealed envelope.  Crawford Park is open daily until dusk for pre-bid inspections of the project site.  For appointments, please contact Victor Federico, Director of Parks and Facilities at (914) 305-2665.


BID SECURITY: A certified check or satisfactory bid bond payable to the Town of Rye, in the amount of five  percent (5%) of the bid, shall accompany each bid as a guaranty, that if the bid is accepted, the Bidder will execute and file the contract and the certificate of insurance, as required by the contract.  Should the Bidder fail in meeting this provision, then the amount of the certified check or bid bond will be forfeited to the Town as liquidated damages.


BID WITHDRAWAL: No bid shall be withdrawn for a period of thirty (30) days after the scheduled opening of the bids without the consent of the Rye Town Park Commission. Also, no bid can be resubmitted by a bidder that has successfully withdrawn a bid prior to the bid opening.

PUBLIC NOTICE


NOTICE IS HEREBY GIVEN that the Town Council of the Town of Rye (the “Town”), a municipal corporation of the State of New York, located in the County of Westchester, has on the 21st day of September 2023, duly adopted, pursuant to the Local Finance Law of New York, a bond resolution which:


(1) authorizes the Town Council to finance the costs of the acquisition, construction and reconstruction of facilities of the Rye Town Park Commission, including improvements to accessibility, security and information technology improvements, replacement of maintenance and safety equipment and vehicles, upgrades to existing facilities and structures, including bathhouse renovations and related parking and infrastructure, and authorizes the issuance of up to $253,850 aggregate principal amount of serial bonds of the Town to finance the costs of such purpose, and


(2) states the estimated maximum total costs of such acquisition, construction and reconstruction to be not in excess of $253,850, states that such costs will be financed, in whole or in part, with the issuance of obligations authorized in such bond resolution in the amount of $253,850 and sets forth the plan of financing of the costs for such purpose, and


(3) determines the period of probable usefulness of the purpose to be fifteen (15) years, and


(4) determines that the maximum maturity of such serial bonds will be in excess of five (5) years, and


(5) delegates to the Town Supervisor the power to prescribe the terms, form and contents of such serial bonds and the power to authorize the issuance of, and the power to prescribe the terms, form and contents of, any bond anticipation notes issued in anticipation of the issuance of such serial bonds, including renewals thereof, and to issue, sell and deliver such serial bonds and such bond anticipation notes, and


(6) states that the validity of such serial bonds, or of such bond anticipation notes issued in anticipation of the issuance of such serial bonds, may be contested only if (a) such obligations are authorized for an object or purpose, or class of object or purpose, for which the Town is not authorized to expend money, or (b) the provisions of law, which should have been complied with at the date of the publication of such bond resolution, were not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty (20) days after the date of such publication, or (c) if such obligations are authorized in violation of the provisions of the Constitution of the State of New York.


Such bond resolution is subject to a permissive referendum under the provisions of Article 7 of the Town Law and petitions protesting against such bond resolution and requesting that it be submitted to the electors of the Town for their approval or disapproval may be filed with the Town Clerk at any time within thirty (30) days after the date of the adoption of such bond resolution.

NOTICE OF HEARING ON APPLICATION


NOTICE IS HEREBY GIVEN that an application to appear before the Zoning Board of Appeals of the Village of Port Chester has been filed regarding the matter below:

Proposal Applicant proposes to install eight signs at 37 Westchester Avenue located in the CD-5W Zoning District. The proposal includes the following enumerated sign types which do not conform to Chapter 345, Article 7 Sign Standards of the Village of Port Chester Zoning Law.



The applicant does hereby request variances from the following applicable sections of the Zoning Ordinance:


1. 345-701. E. Allowed Signs. There shall be no Signs allowed other than as specified in this § 345-701. and


2. 345-701. H. (1) General Provisions Applicable to All Nonexempt Signs. Without limitation to any applicable specific Sign standards, all Signs other than Exempt Signs shall comply with the following additional standards: (1) Lighting. Signs may be, but are not required to be, lighted unless otherwise specifically stated for the particular Sign type in Table 345.701.B (Sign Types: Specific Standards); and if lighted, shall not be internally illuminated or backlighted except as otherwise specifically provided for the particular Sign type in Table 345.701.B (Sign Types: Specific Standards).


A Public Hearing on said application will be held before the Village Zoning Board of Appeals on Thursday, October 19th, at 7 p.m. at the Town of Rye Justice Courtroom located at 350 N. Main St, 2nd Floor, Port Chester, NY 10573.
