NOTICE IS HEREBY GIVEN, that a public hearing of the qualified voters of the Port Chester-Rye Union Free School District, Westchester County, Port Chester, New York, will be held in the Port Chester Middle School in said district, on Thursday, May 9, 2024, at 7:00 p.m. prevailing time, for the presentation of the budget. Nominating petitions shall not describe any specific vacancy upon the Board for which the candidate is nominated; must be directed to the Clerk of the District; must be signed by at least 32 qualified voters (2 percent of the number of voters who voted in the previous annual election of the members of the school board). Vacancies shall be filled in a descending order of valid tabulated votes, as canvassed at the Annual Election. The Board of Registration will meet for the purpose of registering all qualified voters of the District pursuant to §2014 of the Education Law at the Middle School, on Monday, May 13, 2024, between the hours of 2:30 p.m. until 6:30 p.m. prevailing time, in the office of the District Clerk located in the Port Chester Middle School to add any additional names to the register and to prepare the register of the school district for said annual meeting and election. Any person shall be entitled to have his or her name placed upon such register provided that at such meeting of the Board of Registration, he or she is known or proven to the satisfaction of such Board of Registration to be then or thereafter qualified to vote at said annual meeting and election. No person shall be entitled to vote at said annual meeting and election whose name does not appear on the register of the school district.

And notice is also given that said register will be filed in the office of the District Clerk on Tuesday, May 14, 2024, and will thereupon be open for inspection by any qualified voters of the district during school business hours on each of the five (5) days prior to the day set for said meeting and election, excluding Sunday, and on Saturday, May 18, 2024 between the hours of 9:00 a.m. and 1:00 p.m. prevailing time, and at the polling place on the day of the vote.

And notice is also given that military voters who are not currently registered may apply to register as a qualified voter of the school district. Military voters may apply to register to vote with the District Clerk in person in the office of the District Clerk located in the Port Chester Middle School or by calling that office 914-934-7922. Upon such request for a military voter application, such military voter may indicate his/her preference for receiving the application for registration by mail, facsimile or electronic mail. Such registration application must be received in the office of the District Clerk no later than 5:00 p.m. on May 10, 2024, the last business day before the school district’s board of registration will meet to prepare the school district register. Such registration application shall be considered by the board of registration at its meeting to prepare the register of voters for such annual meeting and election. Any military voter shall be entitled to have his/her name placed upon such register, provided, that at such meeting of the board of registration, he/she is known or proven to the satisfaction of such board of registration, to be then or thereafter entitled to military voter status at the annual meeting and election for which such register is prepared. A list of all persons to whom military ballots shall have been issued will be available in the said Office of the Clerk of the District during school business hours on each of the five days prior to the date set for the annual meeting and election, except Sunday, and on Saturday, May 18, 2024 between the hours of 9:00 a.m. and 1:00 p.m., and on the date set for the annual meeting and election.

In accordance with Part 122 of the Rules and Regulations of the Commissioner of Education, military voters who are qualified voters of the school district may apply for a military ballot. Applications for military ballots for the election of two members of the Board of Education, for voting on the annual school district budget, and for voting on any propositions, may be requested from the office of the District Clerk, located in the Port Chester Middle School or by calling that office 914-934-7922. Upon such request for a military voter ballot application, such military voter may indicate his/her preference for receiving the application by mail, facsimile or electronic mail. Completed military ballot applications must be received by the Clerk of the District no later than 5:00 pm on April 25, 2024.

And notice is also given that the Board of Registration will meet May 21, 2024, during the annual election at the place and time of said election for the purpose of preparing a register for meetings and elections held subsequent to said annual meeting and election.

AND FURTHER NOTICE IS HEREBY GIVEN, that pursuant to a rule adopted by the Board of Education in accordance with §§2035 and 2008 of the Education Law, petitions must be filed with the District Clerk at least sixty (60) days prior to the annual election, and any referenda seeking amendments to the budget or propositions otherwise being submitted for voting as said election shall be filed with the Board of Education at the Administration Building, which is housed in the Middle School, no later than thirty (30) days prior to the annual meeting/election; must be typed or printed in the English language; must be directed to the Clerk of the School District; must be signed by at least 79 qualified voters of the District (five percent of the number of voters who voted in the previous annual election of board members); and must state the name and residence of each signer. NOTICE IS HEREBY GIVEN that a Public Budget Hearing of the Blind Brook-Rye Union Free School District shall be held on Tuesday, May 14, 2024 at 7:30 o’clock in the evening in the Monroe E. Haas IMC at Blind Brook Middle/High School on King Street, Rye Brook, New York, for the purpose of discussion of the expenditure of funds and budgeting thereof;

AND FURTHER NOTICE IS HEREBY GIVEN that the annual election of the Board of Education be held on Tuesday, May 21, 2024 between the hours of 7:00 o’clock in the forenoon and 9:00 o’clock in the evening of said day, in said main building Gym of the Bruno M. Ponterio Ridge Street School on North Ridge Street, for the purpose of electing two (2) school board members, for three-year terms, beginning July 1, 2024 and expiring June 30, 2027, to fill the expiring terms of Scott Jaffee and Jeffrey Mensch. Petitions for nominating candidates for such office shall be in accordance with Section 2018 of the Education Law and must be filed with the Clerk of the School District at his office in the Ridge Street School not later than April 22, 2024 between the hours of 9:00 a.m. and 5:00 p.m. Vacancies on the Board of Education are not considered separate, specific offices; candidates run at large. Nominating petitions shall not describe any specific vacancy upon the Board for which the candidate is nominated; must be directed to the Clerk of the District; must be signed by at least twenty-five (25) qualified voters of the District; must state the name and residence of each signer, and must state the name and residence of each candidate.

 AND FURTHER NOTICE IS HEREBY GIVEN, that the vote upon the Proposition for appropriation of necessary funds to meet estimated expenditures for the school year 2024-2025 for school purposes (Annual Budget and Tax Levy) shall also be held on Tuesday, May 21, 2024 between the hours of 7:00 o’clock in the forenoon and 9:00 o’clock in the evening, in said main building Gym of the Bruno M. Ponterio Ridge Street School on North Ridge Street, at which time the polls will be opened to vote by voting machine upon the following items:

1.To adopt the annual budget of the School District for the fiscal year 2024-2025 and to authorize the requisite portion thereof to be raised by taxation on the taxable property of the District;

2.To authorize the lease purchase of one (1) school bus in the 2024-2025 fiscal year;

"Shall the Board of Education of the Blind Brook-Rye Union Free School District ("District") be authorized to lease-purchase or purchase by installment contract one (1) 72-passenger school buses at a cost not to exceed $151,275, plus interest, for a five (5) year term, commencing July 1, 2024 and terminating on June 30, 2029, and to levy the necessary tax therefor?"

3.To authorize the expenditure of monies from the District’s Capital Reserve Fund;

"Shall the Board of Education of the Blind Brook-Rye Union Free School District be authorized, to expend from the Capital Reserve Fund, which was established on May 16, 2023 (“Reserve Fund”) pursuant to Section 3651 of the Education Law, and the general fund, for the following capital improvement projects: replacing the turf field carpet at Blind Brook High School in the approximate amount of $1,200,000, and other work required in connection therewith; and to expend from the Reserve Fund and General Fund therefore, including preliminary costs and costs incidental thereto an amount not to exceed the estimated total cost of $1,200,000?"

AND FURTHER NOTICE IS HEREBY GIVEN, that personal registration of qualified voters is required either pursuant to the Education Law or Election Law. If a voter has heretofore registered pursuant to Education Law §2014 and has voted at an annual or special District meeting within the last four (4) calendar years, they are eligible to vote at this election; if a voter is registered and eligible to vote under Article 5 of the Election Law, they are also eligible to vote at this election. All other persons who wish to vote must register at the District Clerk’s Office of the Bruno M. Ponterio Ridge Street School on North Ridge Street between the hours of 4:00 p.m. and 6:00 p.m. on Wednesday, May 15, 2024;

AND FURTHER NOTICE IS HEREBY GIVEN, that the Board of Registration will also meet during the foregoing election and vote on the annual budget and tax levy in the main building Gym of the Bruno M. Ponterio Ridge Street School on North Ridge Street between 7:00 o’clock in the forenoon and 9:00 o’clock in the evening, for the purpose of preparing a register for elections to be held subsequent to such election;

 AND FURTHER NOTICE IS HEREBY GIVEN, that the register pursuant to Section 2014 of the Education Law will be filed for inspection in the office of the Clerk of the School District in the Bruno M. Ponterio Ridge Street School, North Ridge Street, Rye Brook, New York, and will be open for inspection by any qualified voter of the District on May 16, 2024, between the hours of 9:00 o’clock in the forenoon and 3:00 o’clock in the afternoon on weekdays, and each day prior to the day set forth for election, except Sunday, and at the polling place(s) on the day of the vote.

AND FURTHER NOTICE IS HEREBY GIVEN, that a copy of the detailed statement in writing of the amount of money which will be required for the school year 2024-2025 for school purposes, specifying the several purposes and the amount of each (2024-2025 budget) as provided by Section 1716 of the Education Law may be obtained by any taxpayer in the District between the hours of 9:00 o’clock in the forenoon and 3:00 o’clock in the afternoon beginning May 7, 2024 and thereafter, except Saturday, Sunday or holidays, in the Main Office at the Bruno M. Ponterio Ridge Street School, North Ridge Street, Rye Brook, New York and the Main Office at the Blind Brook Middle/High School, King Street, Rye Brook, New York, and at the Public Hearing to be held as aforesaid on May 14, 2024;

AND FURTHER NOTICE IS HEREBY GIVEN that any other proposition not requiring official notice in the call of the Annual Meeting may be voted upon at said election, subject to the provisions of Section 2035 of the Education Law, provided a proposition is filed with the District Clerk on or before March 22, 2024 at 5:00 p.m. prevailing time; said proposition must be typed or printed in the English language; must be directed to the Clerk of the School District; must be signed by at least twenty-five (25) qualified voters of the District; and must state the name and residence of each signer. The School Board will not entertain any petition to place before the voters any proposition the purpose of which is not within the powers of the voters to determine, or any proposition which fails to include a specific appropriation where the expenditure of monies is required by the proposition.

 AND FURTHER NOTICE IS HEREBY GIVEN, that applications for absentee and early mail ballots are available at the District Office or on the District website (www.blindbrook.org) and, in accordance with Education Law §§ 2018-a and 2018-e, may be submitted to the District Clerk no earlier than thirty (30) days before the election which is April 22, 2024. Completed applications must be received by the District Clerk no later than May 14, 2024 if the ballot is to be mailed to the voter or May 20, 2024 if the ballot is to be personally delivered to the voter. All absentee and early mail ballots must be received in the Clerk’s office by 5:00 p.m., prevailing time, on the day of the election. A list of all persons to whom absentee ballots shall have been issued and a list of all persons to whom early mail voter’s ballots shall have been issued, will be available in said office of the Clerk on each of the five (5) days prior to the day of the election except Sunday, and such list shall also be posted at the polling place or places at the election of members of the Board of Education. Any qualified voter present in the polling place may object to the voting of the ballot upon appropriate grounds for making his/her challenge and the reasons therefor known to the Inspector of Election before the close of the polls. A challenge to an absentee ballot may not be made on the basis that the voter should have applied for an early mail ballot.

 AND FURTHER NOTICE IS HEREBY GIVEN, that Education Law makes special provisions for absentee voting by “permanently disabled” voters of the District and any questions regarding these rights should be directed to the Clerk of the Board. All completed ballots shall be mailed to the Office of the District Clerk no later than 5:00 p.m. on May 21, 2024.

 AND FURTHER NOTICE IS HEREBY GIVEN, that military voters who are not currently registered may apply to register as a qualified voter of the Blind Brook-Rye Union Free School District. A military voter registration application may be requested from the Board of Education at 390 North Ridge Street, Rye Brook, New York and must be returned to the Office of the District Clerk at 390 North Ridge Street, Rye Brook, New York not later than 5:00 pm on April 25, 2024. A military voter may indicate their preference for receiving the registration application by mail, facsimile transmission, or email.

 AND FURTHER NOTICE IS HEREBY GIVEN, that Education Law also makes special provisions for absentee voting for “military” voters of the District. Specifically, the law provides a unique procedure for “military ballots” in school district votes. Whereas absentee ballots must be received by the voter by mail, a military voter may elect to receive his/her absentee ballot application and absentee ballot by mail, email or facsimile. If a military voter does not designate a preference, the board of education shall transmit the military ballot application or military ballot by mail. If a military voter designates a preference for facsimile transmission or electronic mail but does not provide the necessary facsimile number or e-mail address, the board of education shall transmit the voter registration application, military ballot application or military ballot by mail and request the omitted information. The military voter must, however, return his/her original military ballot application and military ballot by mail or in person, regardless of how the absentee application or ballot was received. The Clerk of the Board shall transmit the military voter’s military ballot in accord with the military voter’s preferred method of transmission, or if not preference by mail, not later than April 26, 2024. The Clerk of the Board must then receive the military voter’s military ballot by mail not later than 5:00 p.m. on the day of the vote.

AND BE IT FURTHER RESOLVED, that three voting machines shall be used for recording the vote of annual elections, annual budget and tax levy, and vote on all other propositions listed in this Notice and that application be made to the Westchester County Board of Elections, for the use of three voting machines for such purposes, the expense in connection therewith to be defrayed as provided by law;

Si un votante está registrado y es elegible para votar en virtud del artículo 5 de la Ley Electoral, también es elegible para votar en esta elección.  Y POR LA PRESENTE ADEMÁS SE AVISA, que el registro de conformidad con la Sección 2014 de la Ley de Educación se archivará para su inspección en la oficina de la Secretaria del Distrito Escolar en la Escuela Bruno M. Ponterio Ridge Street, North Ridge Street, Rye Brook, Nueva York, y estará abierto a la inspección de cualquier votante cualificado del Distrito el 16 de mayo de 2024, entre las 9:00 de la mañana y las 3:00 de la tarde de lunes a viernes, y cada día anterior al día establecido para la elección, excepto el domingo, y en el(los) lugar(es) de votación el día de la votación.

 Y POR LA PRESENTE ADEMÁS SE AVISA, que las solicitudes de boletas de voto en ausencia y votación temprana por correo están disponibles en la Oficina del Distrito o en el sitio web del Distrito (www.blindbrook.org) y, de acuerdo con las secciones 2018-a y 2018-e de la Ley de Educación pueden entregarse a la Secretaria del Distrito no antes de treinta (30) días previos a la elección el 22 de abril de 2024.  Y POR LA PRESENTE ADEMÁS SE AVISA, que la Ley de Educación establece disposiciones especiales para el voto en ausencia por parte de los votantes "permanentemente discapacitados" del Distrito y cualquier pregunta sobre estos derechos debe dirigirse a la Secretaria de la Junta.  Y POR LA PRESENTE ADEMÁS SE AVISA, que los votantes militares que no están registrados actualmente pueden solicitar registrarse como votantes cualificados del Distrito Escolar Blind Brook-Rye Union Free. Mientras que el votante debe recibir las boletas de voto en ausencia por correo, un votante militar puede optar por recibir su solicitud y boleta de voto en ausencia por correo, correo electrónico o fax. Si un votante militar no designa una preferencia, la junta de educación enviará la solicitud de votación militar o la boleta militar por correo. Si un votante militar designa una preferencia por transmisión facsímil o correo electrónico, pero no proporciona el número de facsímil o dirección de correo electrónico necesarios, la junta de educación enviará la solicitud de registro de votante, la solicitud de boleta militar o la boleta militar por correo y solicitará la información omitida. Sin embargo, el votante militar debe devolver su solicitud original de boleta militar y su boleta militar por correo o en persona, independientemente de cómo se haya recibido la solicitud o la boleta de voto en ausencia.
