This is a courtesy reminder to all taxpayers whose property is located in the Port Chester-Rye Union Free School District, Blind Brook-Union Free School District and the Rye Neck-Union   Free School  District that  the first half of the school  tax must be paid by September 30, 2024. Payments must be postmarked by the U S Post Office no later than  September 30, 2024. If payment is not received by that date, a mandatory penalty of 2% will be added for the month of October and will increase monthly thereafter.


For your convenience, there are three ways for you to make payments.


1) You may mail your check in the envelope provided. Be sure to include the first half stub of the bill. If you would like a receipt, mark the appropriate box on the stub. Payments must be postmarked by the US Post Office no later than September 30, 2024 to avoid the penalty.


2)You may also drop your payment in the special locked box in front of the building at 222 Grace Church Street, Port Chester. Include the whole bill with your payment and we will mail you a receipt. No postage is required.


3)You may pay on line. You may pay by credit card. Please be advised that there is a convenience fee of 2.35% that will be applied to all payments made with credit cards, debit cards (Mastercard, Visa, Discover, American Express) and Pay Pal. The minimum fee is $1.95. A convenience fee of $1.50 will be applied to all payments made with ACH/eCheck. You may also pre-schedule your tax payment date. NOTICE IS HEREBY GIVEN that sealed bids will be received by the Village of Port Chester until Thursday, November 21, 2024 at 3:00 p.m. local time at the Office of the Village Clerk, 222 Grace Church Street, Port Chester, New York 10573, at which time and place said sealed bids will be publicly opened and read out aloud for


“Sanitary Sewer Upgrades – Phase 1”


No bids will be received or considered after the date/time stated above.


Proposals that do not include an electronic format submission will not be considered.


This work consists of the construction of new sanitary sewer infrastructure, the replacement of existing sewer systems, and the relocation of current sanitary, storm infrastructure. Additionally, it includes rock excavation and the replacement of existing asphalt pavement, concrete sidewalks, and curbs.


A Pre-Bid conference will not be held. Bidding contractors are strongly encouraged to visit the project site before submitting bids.

NOTICE OF PUBLIC HEARING


NOTICE IS HEREBY GIVEN that a public hearing pursuant to Article 18-A of the New York General Municipal Law (the “Act”) will be held by the Village of Port Chester Industrial Development Agency (the “Agency”) on Wednesday, October 2, 2024 at 6:30 p.m. at the Rye Town Courthouse, 350 North Main Street, Port Chester, New York 10573, in connection with the matter described below. 


28 PEARL STREET DEVELOPMENT LLC, for itself and/or a related entity or entities to be formed (collectively, the “Company”), has submitted an application to the Agency requesting the Agency’s assistance with a certain project (the “Project”) consisting of: (i) the acquisition by the Agency of a leasehold interest in approximately .45 acres of real property located 28 and 34 Pearl Street in the Village of Port Chester, New York (the “Land”, being more particularly described as tax parcel numbers 142.30-1-83 and 142.30-1-84, as may be merged) along with the existing improvements thereon consisting principally of parking, curbage and other site improvements (the “Existing Improvements”); (ii) the demolition of the Existing Improvements and the planning, design, construction, operation and leasing by the Company of an approximately 176,000 square foot, nine story redevelopment project that will include: (a) 126 market rate residential apartment units and 14 affordable residential apartment units (consisting of approximately 54 studio, 49 one-bedroom and 37 two-bedroom units), (b) structured parking improvements providing for a minimum of 90 parking spaces, and (c) various common spaces, leasing offices, subsurface structural improvements, roadway improvements, access and egress improvements, storm water improvements, onsite and offsite utility improvements, signage, curbage, sidewalks, and landscaping improvements (collectively, the “Improvements”); (iii) the acquisition of and installation in and around the Improvements by the Company of machinery, equipment, fixtures and other items of tangible personal property (the “Equipment” and, collectively with, the Land, the Existing Improvements and the Improvements, the “Facility”); and (iv) entering into a straight lease transaction (within the meaning of subdivision (15) of Section 854 of the Act), pursuant to which the Agency will retain a leasehold interest in the Facility for a period of time and sublease such interest in the Facility back to the Company (the “Straight Lease Transaction”).


The Agency is contemplating providing financial assistance to the Company with respect to the Project (collectively, the “Financial Assistance”) in the form of:  (A) an exemption from all State and local sales and use taxes with respect to qualifying personal property included in or incorporated into the Facility or used in the acquisition, construction or equipping of the Facility; (B) mortgage recording tax exemption(s) relating to financings undertaken by the Company in furtherance of the Project, and (C) a partial real property tax abatement through a payment-in-lieu-of-tax agreement (collectively, the “PILOT Agreement”), pursuant to which the Company would make payments in lieu of real property taxes to each affected tax jurisdiction (the “Affected Tax Jurisdictions”). 


In accordance with Section 859-a of the Act, a representative of the Agency will be at the above-stated time and place to present a copy of the Company’s Project Application (including a cost-benefit analysis), which is also available for viewing on the Agency’s website at: https://www.portchesternyida.org/public-hearing-notices. Interested parties will be provided a reasonable opportunity, both orally and in writing, to present their views with respect to the Project.  The Agency will also stream the public hearing via a video link that will also be provided at https://www.portchesterny.gov/204/Port-Chester-TV. NOTICE IS HEREBY GIVEN that pursuant to a resolution of the Board of Education of Blind Brook-Rye Union Free School District, in the County of Westchester, New York, adopted on August 28, 2024, a Special District Meeting of the qualified voters of said School District will be held on

Tuesday, October 22, 2024

from 7:00 o’clock A.M. to 9:00 o’clock P.M. (Prevailing Time) in the main building Gym of the Bruno M. Ponterio Ridge Street School on North Ridge Street, Rye Brook, New York, for the purpose of voting upon the following Bond Proposition:

BOND PROPOSITION

(a) That the Board of Education of Blind Brook-Rye Union Free School District, in the County of Westchester, New York (the “District”), is hereby authorized to construct improvements and alterations to District buildings and sites (the “Project”), substantially in accordance with and as described as “Critical” items in a plan prepared by the District with the assistance of BBS Architects, Landscape Architects & Engineers, P.C., (the “Plan”), which plan is available for public inspection at the office of the District Clerk, such Project to include (as and where required): track and baseball field improvements; MS/HS bathrooms renovations, MS/HS HVAC improvements; MS/HS electric service equipment; HS elevator improvements; MS roof rehabilitation; BMPRSS field drainage improvements; reconfiguration of classrooms; and auditorium system improvements; all of the foregoing to include the original furnishing, equipment, machinery, apparatus and ancillary or related site, demolition and other work required in connection therewith; and to expend therefore, including preliminary costs and costs incidental thereto and to the financing thereof, an amount not to exceed the estimated cost of not to exceed $19,500,000, provided that the estimated costs of the components of the Project as set forth in detail in the Plan may be reallocated among such components if the Board of Education shall determine that such reallocation is in the best interests of the District;


(b) that the amount of $1,151,229 from the District’s “Capital Reserve Fund-2022”, approved by the voters of the District on May 17, 2022, is hereby authorized to be expended to pay a portion of the cost of the Project, and such expenditure is hereby approved; and


(c) that a tax is hereby voted in an aggregate amount of not to exceed $18,348,771 to finance the balance of such cost, such tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and that in anticipation of said tax, bonds of the District are hereby authorized to be issued in the aggregate principal amount of not to exceed $18,348,771 and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable.


Such Bond Proposition shall appear on the ballots to be used for voting at said Special District Meeting in substantially the following condensed form:

The voting will be conducted as provided in the Education Law and the polls will remain open from 7:00 o’clock A.M. to 9:00 o’clock P.M. (Prevailing Time) and as much longer as may be necessary to enable the voters then present to cast their ballots.

NOTICE IS FURTHER GIVEN, that members of the Board of Registration shall meet on Wednesday, October 16, 2024, between the hours of 4:00 o’clock P.M. and 8:00 o’clock P.M. (Prevailing Time) in the District Clerk’s office at the Bruno M. Ponterio Ridge Street School, Rye Brook, New York, for the purpose of preparing a register of the qualified voters of the District for said Special District Meeting, at which time any person shall be entitled to have his/her name placed upon such register, provided that at such meeting of the Board of Registration he/she is known or proven to the satisfaction of such Board of Registration to be then or thereafter entitled to vote at said Special District Meeting.

The register of the qualified voters of said District prepared for the Annual District Meeting and Election held on May 21, 2024 shall be used by said Board of Registration as the basis for the preparation of the register for said Special District Meeting to be held on October 22, 2024.  Any person whose name appears on such register or who shall have been previously registered for any annual or special District meeting or election and who shall have voted at any annual or special district meeting or election held or conducted at any time since January 1, 2020, will not be required to register personally for this Special District Meeting.  In addition, any person otherwise qualified to vote who is registered with the Board of Elections of Westchester County under the provisions of the Election Law shall be entitled to vote at said Special District Meeting without further registration.

Following the meeting of the Board of Registration, such register will be filed in the Office of the District Clerk, where such register will be open for inspection by any qualified voter of said School District, between the hours of 9:00 o’clock A.M. and 3:00 o’clock P.M. (Prevailing Time), except Sunday and on Saturday, October 19, 2024,  by appointment only.

AND FURTHER NOTICE IS HEREBY GIVEN, that applications for absentee and early mail ballots are available at the District Office or on the District website (www.blindbrook.org) and, in accordance with Education Law §§ 2018-a and 2018-e, may be submitted to the District Clerk no earlier than thirty (30) days before the election which is September 23, 2024. Completed applications must be received by the District Clerk no later than October 15, 2024 if the ballot is to be mailed to the voter or October 21, 2024 if the ballot is to be personally delivered to the voter. All absentee and early mail ballots must be received in the Clerk’s office by 5:00 o’clock P.M. (Prevailing Time), on the day of the election. A list of all persons to whom absentee ballots shall have been issued and a list of all persons to whom early mail voter’s ballots shall have been issued, will be available in said office of the Clerk on each of the five (5) days prior to the day of the election except Sunday, and such list shall also be posted at the polling place. Any qualified voter present in the polling place may object to the voting of the ballot upon appropriate grounds for making his/her challenge and the reasons therefor known to the Inspector of Election before the close of the polls. A challenge to an absentee ballot may not be made on the basis that the voter should have applied for an early mail ballot.

AND FURTHER NOTICE IS HEREBY GIVEN, that military voters who are not currently registered may apply to register as a qualified voter of Blind Brook-Rye Union Free School District. A military voter registration application may be requested from the Board of Education at 390 North Ridge Street, Rye Brook, New York and must be returned to the Office of the District Clerk at 390 North Ridge Street, Rye Brook, New York not later than 5:00 o’clock P.M. (Prevailing Time) on September 25, 2024. A military voter may indicate their preference for receiving the registration application by mail, facsimile transmission, or email.

AND FURTHER NOTICE IS HEREBY GIVEN, that Education Law also makes special provisions for absentee voting for “military” voters of the District. Specifically, the law provides a unique procedure for “military ballots” in school district votes. Whereas absentee ballots must be received by the voter by mail, a military voter may elect to receive his/her absentee ballot application and absentee ballot by mail, email or facsimile. If a military voter does not designate a preference, the board of education shall transmit the military ballot application or military ballot by mail. If a military voter designates a preference for facsimile transmission or electronic mail but does not provide the necessary facsimile number or e-mail address, the board of education shall transmit the voter registration application, military ballot application or military ballot by mail and request the omitted information. The military voter must, however, return his/her original military ballot application and military ballot by mail or in person, regardless of how the absentee application or ballot was received. The Clerk of the Board shall transmit the military voter’s military ballot in accord with the military voter’s preferred method of transmission, or if not preference by mail, not later than September 26, 2024. The Clerk of the Board must then receive the military voter’s military ballot by mail not later than 5:00 o’clock P.M. (Prevailing Time) on the day of said Special District Meeting.

Only qualified voters who are registered to vote will be permitted to vote.

(a) Que la Junta de Educación del Distrito Escolar Blind Brook-Rye Union Free, en el condado de Westchester, Nueva York (el “Distrito”), está autorizada a construir mejoras y alteraciones en los edificios y sitios del Distrito (el “Proyecto”), sustancialmente de acuerdo con y como se describe en los ítems “Críticos” de un plan preparado por el Distrito con la ayuda de BBS Architects, Landscape Architects & Engineers, P.C., el “Plan”), cuyo plan está disponible para su inspección pública en la oficina de la Secretaria del Distrito, y dicho proyecto incluirá ( según y cuando sea necesario): mejoras en las pistas y campos de béisbol; Renovaciones de baños de MS/HS, mejoras de HVAC de MS/HS; Equipos de servicio eléctrico MS/HS; mejoras en los ascensores de HS; rehabilitación de techos de MS; mejoras en el drenaje del campo BMPRSS; reconfiguración de aulas; y mejoras en el sistema del auditorio; todo lo anterior incluye el mobiliario, el equipo, la maquinaria, los aparatos y el sitio auxiliar o relacionado, la demolición y otros trabajos originales necesarios en relación con los mismos; y gastar por lo tanto, incluidos los costos preliminares y los costos relacionados con los mismos y con su financiación, una cantidad que no supere el costo estimado de $19,500,000, siempre que los costos estimados de los componentes del Proyecto, tal como se establece en detalle en el Plan, puedan reasignarse entre dichos componentes si la Junta de Educación determina que dicha reasignación es para los mejores intereses del Distrito;


(b) que la suma de $1,151,229 del "Fondo de Reserva de Capital-2022" del Distrito, aprobada por los votantes del Distrito el 17 de mayo de 2022, se autoriza por la presente para pagar una parte del costo del Proyecto, y tales gastos son aprobados por la presente; y


(c) que por la presente se vota un impuesto por un monto que no exceda los $18,348,771 para pagar el saldo del costo, dicho impuesto se impondrá y recaudará en cuotas en los años y en los montos que determine dicha Junta de Educación; y que en previsión de dicho impuesto, por la presente se autoriza la emisión de bonos del Distrito por un monto de capital que no exceda los $18,348,771 y por la presente se vota un impuesto para pagar los intereses de dichos bonos a medida que vencen y son pagaderos.


Dicha Propuesta de Bono aparecerá en las boletas utilizadas para votar en dicha Reunión Especial de Distrito en sustancialmente la siguiente forma condensada:

SE DA AVISO ADEMÁS, que los miembros de la Junta de Registro se reunirán el jueves 16 de octubre de 2024, entre las 4:00 P.M. y las 8:00 P.M. (Hora Vigente) en la oficina de la Secretaria de Distrito en la Escuela Bruno M. El registro de los votantes cualificados de dicho Distrito preparado para la Elección y Reunión Anual del Distrito Escolar celebrada el 17 de mayo de 2024 será utilizado por dicha Junta de Registro como base para la preparación del registro para dicha Reunión Especial del Distrito que se realizará el 22 de octubre de 2024.  Cualquier persona cuyo nombre aparezca en dicho registro o que se haya registrado previamente para una reunión o elección anual o especial del Distrito y que haya votado en cualquier reunión o elección anual o especial del Distrito celebrada o realizada en cualquier momento desde el 1 de enero de 2020, no necesita registrarse  personalmente para esta reunión especial del distrito.  Además, cualquier persona cualificada para votar que esté registrada en la Junta Electoral del Condado de Westchester bajo las disposiciones de la Ley Electoral tendrá derecho a votar en dicha Reunión Especial del Distrito sin más registro.

Después de la reunión de la Junta de Registro, dicho registro se presentará en la Oficina de la Secretaria del Distrito, donde dichos registros estarán abiertos para la inspección de cualquier votante cualificado de dicho Distrito Escolar, entre las 9:00 A.M. y las 3:00 P.M. (Hora Vigente), excepto el domingo y el sábado 19 de octubre de 2024, cuando se podrá hacer sólo con cita previa.

Y POR LA PRESENTE ADEMÁS SE AVISA, que las solicitudes de boletas de voto en ausencia y votación temprana por correo están disponibles en la Oficina del Distrito o en el sitio web del Distrito (www.blindbrook.org) y, de acuerdo con las secciones 2018-a y 2018-e de la Ley de Educación pueden entregarse a la Secretaria del Distrito no antes de los treinta (30) días previos a la elección el 23 de septiembre de 2024. La Secretaria del Distrito debe recibir las solicitudes completas a más tardar el 15 de octubre de 2024 si la boleta se enviará por correo al votante o el 21 de octubre de 2024 si la boleta se entregará personalmente al votante. Todas las boletas de votación en ausencia y por correo anticipado deben recibirse en la oficina de la secretaria antes de las 5:00 P.M. (Hora Vigente), el día de la elección. Una lista de todas las personas a quienes se les habrá emitido boletas de voto en ausencia y una lista de todas las personas a quienes se les habrá emitido boletas de votación temprana por correo estará disponible en dicha oficina de la Secretaria cada uno de los cinco (5) días antes del día de la elección, excepto el domingo, y dicha lista también se publicará en el lugar de votación. Cualquier votante cualificado presente en el lugar de votación puede oponerse a la votación de la boleta electoral con motivos pertinentes para presentar su impugnación y las razones y hacerlas saber al Inspector de Elecciones antes del cierre de los centros de votación.  No se puede impugnar una boleta de voto en ausencia sobre la base de que el votante debería haber solicitado una boleta de votación anticipada por correo.

Y POR LA PRESENTE ADEMÁS SE AVISA, que los votantes militares que no están registrados actualmente pueden solicitar registrarse como votantes cualificados del Distrito Escolar Blind Brook-Rye Union Free. Una solicitud de registro de votante militar puede ser solicitada a la Junta de Educación en 390 North Ridge Street, Rye Brook, New York y debe ser devuelta a la Oficina de la Secretaria del Distrito en 390 North Ridge Street, Rye Brook, Nueva York no más tarde de las 5:00 P.M. (Hora Vigente) el 25 de septiembre de 2024. El votante militar puede indicar su preferencia de recibir la solicitud de registro por correo, fax o correo electrónico.

Y POR LA PRESENTE ADEMÁS SE AVISA, que la Ley de Educación también establece disposiciones especiales para el voto en ausencia de los votantes "militares" del Distrito. Específicamente, la ley proporciona un procedimiento único para las "boletas militares" en los votos del distrito escolar. Mientras que el votante debe recibir las boletas de voto en ausencia por correo, un votante militar puede optar por recibir su solicitud y boleta de voto en ausencia por correo, correo electrónico o fax. Si un votante militar no designa una preferencia, la junta de educación enviará la solicitud de votación militar o la boleta militar por correo. Si un votante militar designa una preferencia por transmisión facsímil o correo electrónico, pero no proporciona el número de facsímil o dirección de correo electrónico necesarios, la junta de educación enviará la solicitud de registro de votantes, la solicitud de boleta militar o la boleta militar por correo y solicitará la información omitida. Sin embargo, el votante militar debe devolver su solicitud original de boleta militar y su boleta militar por correo o en persona, independientemente de cómo se haya recibido la solicitud o la boleta de voto en ausencia. La Secretaria de la Junta enviará la boleta militar del votante militar de acuerdo con el método de envío preferido por el votante militar, o si no hay preferencia, por correo, a más tardar el 26 de septiembre de 2024. La Secretaria de la Junta debe recibir la boleta de voto militar de los votantes militares por correo no más tarde de las 5:00 P.M.  Hora Vigente) el día de la Reunión Especial del Distrito.

Sólo los votantes cualificados que están registrados para votar podrán votar.
