While stationed in a lot on South Regent Street, a Port Chester police officer was approached by a passerby claiming someone was disrupting traffic while attempting to park near the intersection of South Regent and Clinton streets on Wednesday, May 1.
The parking attempt was drawing honks and shouts from other drivers, according to the police report.
As the officer approached, the suspect, José Martinez Farias, drove away. The police performed a traffic stop after the 39-year-old turned onto William Street and they allegedly saw a can of liquid being thrown out the car window.
The suspect allegedly told officers he didn’t have a driver’s license. Police claim to have smelled the odor of alcohol coming from Martinez Farias’ breath during their conversation.
After allegedly performing poorly on standardized field sobriety tests, a preliminary breath test detected alcohol in the system of the 227 William St. resident and he was arrested at 7 p.m.
When tested later that evening, his blood alcohol content was measured to be .20%, over double the legal limit of .08%.
Martinez Farias was charged with aggravated driving while intoxicated, a misdemeanor, and received an infraction for driving without a driver’s license.
