A Port Chester Department of Public Works employee entered the Port Chester police station at 350 N. Main St. on Monday, Oct. 28, to report that a garbage truck had been struck by a car outside.

Officers left the building and saw a black Honda Civic with its airbags deployed and the front passenger tire dislodged.

According to the police report, Erwin Mazariegos Gabriel told officers he had 10 beers at a nearby nightclub before getting behind the wheel. The 26-year-old provided officers with a learner’s permit, which allegedly had an address listed that did not match the one found on file during a background check.

Police claim Mazariegos Gabriel’s eyes were bloodshot and they conducted standardized field sobriety tests. He allegedly performed poorly on the examinations and was arrested at 6:24 a.m.

When tested later, Mazariegos Gabriel’s blood alcohol content was discovered to be .12%, over the legal limit of .08%.

The 268 King St. resident was charged with driving while intoxicated, a misdemeanor, and received infractions for driving without a license and failing to notify the DMV of an address change.
