Drunk driving without a license

A 264 King St. resident was arrested after a Rye Brook police officer allegedly found him parked in the middle of Sunset Road on Saturday, Aug. 31.

According to Lieutenant J. Arnold, when the officer approached José Silva’s car, they were able to smell the odor of alcohol from inside. A routine background check allegedly revealed the 29-year-old didn’t have a driver’s license and his privilege to drive had been suspended in January, leading to his arrest at 4:21 a.m.

Upon taking the suspect to the Rye Brook police station, officers conducted standardized field sobriety tests and concluded Silva was under the influence of alcohol.

His blood alcohol content was discovered to be .15%, over the legal limit of .08%.

Silva was charged with driving while intoxicated and aggravated unlicensed operation of a motor vehicle, both misdemeanors.
